Georgia is in the 11th Circuit, so there’s apparently binding precedent that says McBath’s district gets protected.

Then it should play out like it did in the 5th circuit - en banc hearing in March 2024, too late to undo the Congressional map (right? please?) to reverse a rule that the 5th and 11th Circuits may have used (I’m guessing) to strike down a Dem challenge under the VRA . Now the tables being turned, this purpose-built rule serves no Repub purpose and must be voided. Jesus! (Orange, I mean.)

There will be nothing for Mark Elias to challenge. The district court is obligated to follow the 11th Circuit precedent on mixed-minority districts, so McBath’s seat isn’t going anywhere. The special master will just end up redrawing other districts in order to create one more majority-Black district.
