More than eight months after his first sentencing hearing went completely off-the-rails, the new legal team for former National Security Adviser Michael Flynn clashed with federal prosecutors Friday over whether his case is now ready for sentencing.

Just a guess here, but I think that Flynn had second thoughts after the Mueller report largely landed with a thud… so he’s angling to stretch this out as long as possible in hopes that Trump pardons him (either on the way out of office or on the way to the 2nd inaugural).

It also means that he’s betting that prosecutors won’t go back and charge his idiot son under AG Barr.

I believe that to be a really good guess- that plus Flynn just seems to be a little mentally unsound and appears to think he can have his cake (escape jail) and eat it too (continue to rail against the deep state and cite idiotic conspiracy theories as a defense).

I am not a lawyer …(crosses self)…but having pleaded guilty, can’t a judge just say FTS and sentence him?? Anyone? Justice delayed is justice denied.

There’s a stench of cheeto funk on the scales of justice here. They just want to string things along til “whatever” plus trying to get more “what they know” info from the DOJ who I can no longer trust til proven otherwise.

Sentence him to life in prison for treason and call it a day. Then go after his son and lock him up too.

You know, Benedict Arnold was Washington’s favorite “son” general, and one of his ablest leaders. Then he turned traitor. Then Washington wanted his ass on a rope (so to speak) real badly, for betraying him.

Flynn may be a respected war wager, or a psychopathic war hawk, whatever, but now he’s a traitorous greedy dick who waived his rights to respect when he started treating with our world rivals/foes/don’t like em’s.

That confuses me also. He has plead guilty to negotiated charges already I think. So when he claims to need documents “for his defense” WTF is he talking about? As they say on TV, hasn’t his legal team essentially declared “The defense rests, your honor”? Is he claiming he needs access to certain items in the hopes they’ll mitigate the sentence?

He pleaded guilty, but is still allowed to submit mitigating evidence as part of the sentencing process.

Flynn admitted to filing false forms when he pleaded guilty in 2017, but he reportedly now maintains that he didn’t know they were false at the time. Flynn’s team wrote in a July 11 filing that there were “significant issues” they needed to address.

For those of you playing at home, don’t even think about trying this excuse if you’re poor, not connected to powerful people, or are a person of color.

It never ceases to amaze me how much wiggle room the justice system offers those with wealth and power to escape consequences of their actions.

IANAL, but my understanding is that judges defer to the prosecution when they have a cooperating party. However, in this case, I’d say Flynn appears done “cooperating” and the judge should just go with his previous instinct and give him a lengthy stay in a government facility.

So, he doesn’t need them for his defense per se, so much as he needs them for sentencing purposes. Striving for a reduced sentence doesn’t seem to fall into the category or “defense” in many people’s minds I’d wager. He’s done defending himself, now he’s seeking a degree of leniency, no?

I think Manafort will benefit either way with a pardon too. Have not heard anything on his trial concerning state charges other than pleading not guilty in June.
Last I heard, the Justice Department intervened in his place of imprisonment awaiting trial.That resulted in his placement at the Metropolitan Correctional Center.

So his lawyers contend there are items that are serious enough in nature to merit mitigating his sentencing. And apparently Flynn did not have access to them during trial or negotiating his plea. But, if they’re important enough to mitigate a sentence, couldn’t they also be important enough to similarly have weighed on the very plea he entered into in the first place? Why the hell, if they’re that important, aren’t his attorneys demanding another bite at the apple? Another trial? A renegotiation of the original plea? If they’re so critical he wants to see them, now, before sentencing, and so critical it will (allegedly) affect the judge’s opinion of the degree and/or severity of his guilt?
