Federal Judge Rejects Bannon’s Effort To Toss Contempt Of Congress Charges

Bannon and his “lawyers” already know that the executive privilege claims will be rejected.

I’m glad they were rejected quickly. Now on to the next frivolous filing.

No more pardons for you. Time’s up.

I hope Bannon is enjoying his nice new house in Tucson. DoJ will have new quarters for him soon.

Pardons do not cover stupid criming in the future. They are backwards looking documents.

Bear in mind, though, that he’s been indicted on two counts of violating 2 U.S.C. sec. 172, violations of which are a misdemeanor and carry a maximum fine of $1,000 and a maximum period of 12 months’ imprisonment (interestingly, the statute also provides for a minimum period of 30 days). So, it’s not a situation where if he’s taken into the AG’s custody, he’ll be in for anything lengthy, esp. once U.S. Sentencing Guidelines are taken into consideration.

That said, DOJ is doing the right thing by pursuing this. Given that Bannon’s likely ploy is to be the next G. Gordon Liddy with the same infantile geek-hero-worship following, I presume there are no meaningful plea discussions and I look forward to news of an error-free trial and a swift conviction.

ETA I also see no likelihood that the subpoenaed MOCs will take the stand; per Speech and Debate Clause.

You’re going to Prison, Sloppy Steve.

On the plus side the food you’ll eat is probably healthier than the shit sandwiches you’ve been serving up.

And they’ll dry you out.

I really don’t see the subpoenaed Congresscritters taking the stand, the Speech and Debate Clause offering them an out (and I venture Bannon’s attorneys know this and effected service just to make a cynical point that their client is being railroaded, given that the dimwits who comprise Bannon’s fan club are already sold on martyrdom and thus likely to buy it). But I see no value in MOCs testifying even if they were confident they could emerge unscathed, even smelling like roses, after what team Bannon would want to be a hostile examination. It would just be playing along with Bannon and counsel’s attempt at theater, and not how we want out tax dollars spent.

Bannon is off the rails and inciting more very bad behavior.

Why does Bannon get a jury ? The facts are not in dispute an neither is the law. Can’t the Judge just direct the verdict ? It has happened in other J6 prosecutions.

Because he has a right to a jury trial, and his attorneys not being idiots and delay being on his side, will avail himself of that right.

Judges presiding over other J6 prosecutions have taken cases away from the jury? Which ones?

Lock him up!

Lock him up!

Lock him up!

Not always. A trial by jury can be waived and have a bench trial instead.

Wait a second now! As a lifelong Cub fan, I… agree

Yes, that would be the defendant waiving his right to a jury trial, as happened here today:
