Miller is lying. The order to unfreeze only came after Northam activated the VA NG under his own authority, and the DoD realized that there was no way to prevent troops showing up regardless of what they did.

Torn about him. Clearly he was appointed to deliver the country to Trump no matter what, but he held out, at least enough.

Agree he knows way more than he’s letting on, but also have to be a little grateful that, when push came to shove, he at least ultimately came down on the right side.

Did Miller on his own have the authority to release the Guard?

I mean so what if information received from Pence influenced his decision. If he had the authority, he had the authority.

Miller may need to be looking at some time away under federal supervision.
It might jog his memory a bit and straighten out some inconsistencies in his testimonies.
If the case can be made, lying to Congress may be the place to start.

The President has the authority to order up the DC guard. This is standardly delegated to the SECDEF, so, unless there was a secret order reversing that, yes, Miller had the authority to order up the guard.

Conversation with pence in that instance really doesn’t matter, would be just advisory.

Doesn’t matter. Lying to Congress is a federal crime regardless of whether it’s under oath or not.

This hearing has been chaotic to listen to, but this one nugget of info is valuable, We all suspected that the chain of command was breached in order to save the Capitol because everyone knew that Trump was in on the insurrection and would do nothing to stop it. Miller might as well have told the truth. He looks like dumb liar in that exchange.

Though I agree with your assessment I find it interesting that Miller is on a balance beam with truth on one side, and the right side on the other.
We are told that members of the military do not have to follow unlawful orders, but does that hold true for acting against no orders from your commander when your fellow American’s lives are in danger?

Why wasn’t he called during the impeachment hearing? Same with Rosen? Seems like the DP blew it big time here… as usual. This is not a good sign for getting to the bottom of things now, nor to holding those who actively fomented this riot-insurrection on Jan 6 to full account for their disdain for democracy and our Constitution.

Of course, enforcing said crime is difficult under the governmental edict and Supreme Court precedent of “IOKIYAR”
