The trial of Rep. Duncan Hunter (R-CA), who was indicted for misusing campaign funds, has been pushed back until January pending a decision from an appeals court on whether or not to dismiss the case.
Hunter’s lawyers have argued that Duncan is shielded from prosecution by a constitutional provision that involves carrying out legislative duties.
Tell that to William Jefferson and Jesse Jackson Jr. who were both facing federal charges while in office presumably “carrying out legislative duties”.
The guy is a sleazebag. Try him in court already. It should be an open and shut case.
What’s the difference between a good lawyer and a bad lawyer?
A bad lawyer can let a case drag out for several years. A good lawyer can make it last even longer.
Please get an editor. This is poorly written and misleading. If TPM is covering legal cases, have the person at least read a basic civil procedure manual. A lawyer query does not get a trial moved.
A delay until the election year begins doesn’t seem like much of a win. Of course, given the case they seem to have built, a “win” might be hard to find.
Especially since his duties at this point are hardly onerous. He’s been stripped of committee assignments and he never puts forward legislation so all he does is show up occasionally and vote.
