Due to Botched Paperwork, Comey May Never Have Been Properly Indicted

ALEXANDRIA, VA—In a stunning admission, prosecutors in the James Comey case conceded that the two-count indictment against the former FBI director was never presented to or voted on by a grand jury. The paperwork snafu that has bedeviled the case from the beginning came into much sharper focus after persistent questioning from U.S. District Judge Michael…

So, I’m not a lawyer, but this is bad, right? Like really, really bad?

…it was overshadowed by the revelation that there may have been no indictment at all.

"It’s a new kind of indictment, a Schrödinger’s indictment."

The indictment could have used more eye shadow.

This will appealed to the Supreme Court. The conservative justices will fast track the process and rule for the President’s blonde. The President has absolute power and do anything anyway.

I guess just “looking the part” only gets you so far in actual court.  :joy:

Doc coyote, Me thinks that they should all be disbarred including Bondi. How can the ABA expect respect if they don’t hold high ethics itself? Seems like they are hiding rather than leading on this issue. I say this as a non–lawyer, just a regular folk here.

So, the beauty queen/quasi-insurance lawyer may have only ‘presented to a grand jury’ said indictments in her mind. Kind of like de-classifying docs in one’s mind. And the judge didn’t buy it? I’m shocked.

As Kate likes to point out on the podcast, the only consequence the Sinister Six have to endure is the endless parade of clowns coughing up dogs’ breakfasts during oral arguments, assuming they’re entitled to a win. The SC will take the bare minimum, but MAGA Law struggles to provide even that much.

Yes they are. It’s over.

No “botched paperwork” This is from David’s article.

Prosecutors conceded that the draft of the operative two-count second indictment that the case has been proceeding based on was never presented to nor voted on by the grand jury.

Instead, Halligan and the grand jury foreman and another grand juror presented both indictments to a magistrate judge, who noted some of the incongruities and tried to clean up the mess. Different ink used on the two indictments was among the early clues that things might be amiss, and Nachmanoff noted the ink disparity in court today.

I’ve seen some of the other reporters who were in the courtroom, all talking about this and what the foreperson and additional jury were told. Implications being they lied to them about what it was “OK, we fixed it with the first one, so you can just sign for the two you did agree on.”

The American Bar Association is not the organization that admits lawyers to practice. The bar associations of each state do that. And someone who’s been damaged by a lawyer’s misconduct has to file a complaint with that bar association to start that process. A state bat can’t act based on media reports.

We need to see more of this. We need the attorneys for the DOJ to realize that Trump can pardon them and perhaps even refuse to detain them on contempt, but Trump can’t save them from poverty.

Lawyers are very smart people who are mostly useless in almost any other profession save administrative assistant and automotive sales.

This is a joke, and one worth both laughing at and crying over. What’s scary is that, while this incompetence will work to the advantage of Comey remaining a free citizen, this same Dept of Justice is incompetently but forcefully deporting and detaining people. And the incompetent DHS is directing the country with quack science and the incompetent Defense Department is waging illegal wars. The government has been put in the hands of lunatics and we’re all at their mercy. No joke.
