Originally published at: DOJ Takes Tariff Fight to SCOTUS, Opening a New Avenue for Court to Expand Trump’s Power - TPM – Talking Points Memo
Trump administration attorneys asked the Supreme Court on Wednesday night to overturn Friday’s appeals court decision finding that most of Trump’s tariffs are unconstitutional. The filing came after Trump at a Tuesday press conference — ostensibly about moving Space Command from Colorado to Alabama — said his administration would swiftly seek a SCOTUS ruling. The…
Go on, you messianic shites, license this sack of garbage to break the whole economy. Your corruption and contempt will never be more obvious.
I’m actually very much looking forward to blaming permanent price increases on one of the worst SCOTUSes in US history, in addition to the many other evils they’ve visited on us.
It’ll be interesting to see how they claw back presidential power if a Democrat ever regains the office.
Will they just come out and say IOKIYAR but not so much if you’re a Democrat?
SCOTUS only takes about 2% of the cases presented to them. They should decline to even hear this case. The lower court was very clear and their legal reasoning was sound. There’s really nothing for them to decide.
They will decide whether or not we have a king or an executive. I don’t put anything past this group.
They already decided that with the immunity case and the answer was yes.
The idea of checks and balances in the Constitution hinges heavily of the Separation of Powers doctrine. Each branch of government has sole powers and these powers can be used to curb another branch’s action.
The Separation of Powers principle falls apart if the Congress fully cedes its power to control tariffs to the executive branch. It would be like the Supreme Court ceding its power to the president to overturn laws relating to interstate commerce.
I’m wondering if this all comes down to who bet against the tariffs with Lutnick’s Cantor Fitzgerald and, so, stands to have a big pay day if they’re overturned. (POLITICO Pro ) and (https://www.nytimes.com/2025/09/04/business/dealbook/wall-street-trump-tariffs.html )
The regime cites it’s power over foreign relations as the basis for imposition of tariffs on imports but tariffs are an exclusively domestic matter, they don’t coerce foreign exporters to do anything, they only place requirements on domestic importers.
As with SCOTUS rejection of President Biden’s attempt to forgive student loans?
“The President and his Cabinet officials have determined that the tariffs are promoting peace and unprecedented economic prosperity, and that the denial of tariff authority would expose our nation to trade retaliation without effective defenses and thrust America back to the brink of economic catastrophe,” he wrote in his filing.
Everything in there is a falsehood, including “the” and “and.”
I vote the Operatives Justices will go full IOKIYAR and carve out an exception that allows the Tr*mp tax tariffs to continue, with a legal decision so twisted you could bake it into a challah.
The “major questions doctrine” states:
If GQP President - do whatever you want, regardless of any law or constitution to the contrary
If Dem President - can’t do jack.
5-4 decision, IOKIYAR. Handmaiden votes with the Dems as it’s not religious nutjob adjacent.
Either way, Trump will undermine confidence in the rule of law whether he wins or loses in this particular Supreme Court challenge.
