DOJ Sues to Block Alaska Senate Certification if Republican Loses

Originally published at: DOJ Sues to Block Alaska Senate Certification if Republican Loses - TPM – Talking Points Memo

The Justice Department asked a federal judge on Friday to stop Alaska from certifying the winner of the state’s Senate election if Mary Peltola (D) unseats Sen. Dan Sullivan (R-AK) in a close race. It’s the first instance of the DOJ intervening to block the certification of a Senate race to help a losing Republican.…

This is entirely up to the voters in the State of Alaska to do the right thing and not to vote for either of the Dans.

If she comes up with more than 50% of the total vote, the case gets tossed, no matter how many times they demand a recount.

Over a week to go until Election Day and already we’re getting drenched in flop sweat.

If the electorate being idiots and voting for the “wrong” candidate was illegal, we’d never have a GQP winner of an election again..

The State of Alaska already dealt with this, and they are the ones that get to determine how their election is run. This has happened in the past, and it is always the case that the choice of the voters is the determinant in the end. Politicians can’t help having the same name, and trying to disqualify one based on their name would violate the Constitutional requirements for holding an office (someone can’t be ruled ineligible just because of their name).

This case is just meant to cause more drama. It perhaps might swing a few votes back to Sen. Sullivan from people who somehow don’t realize they are two different people. If Sullivan loses, and then the SC tries to install him as senator because of “reasons” it’s going to be a very, very bad thing. Let’s hope Peltola wins easily so there isn’t any question about this lawsuit.

Even if her total exceeds the total of all Sullivans - they will demand a “Do-Over” … because the confusion caused MAGA voter performance anxiety!….and the sun got in their eyes …. Plus some somebody called a time out…

Absolutely. The Alaska Supreme Court allowed Dan J. to remain on the ballot so the FEDERAL government can do nothing about it.

As a practical and legal matter, once a voter submits their ballot, it can’t be altered. Any issues with a confusing ballot have to be resolved beforehand. For precedent, read about the butterfly ballot issue in the 2000 Palm Beach presidential election.

??? Wasn’t that a “one time only” kind of performance? - only applied to this one unique special case!

The Trump administration is clearly desperate. First, they did not wait until the election. Second they brought a terrible case with a worse argument to a court. Third, they risked losing voters over the Administration being sore losers without an election even being run.

I am guessing the internal polls on the Alaska Senate race must be worse than the close race polls we are seeing.

Republicans wish for the 2026 election in Alaska to be nullified, but only if the Republican loses.

Not too keen on free and fair elections, are they? Like who the hell have they been talking to? Vladimir Putin?

Perhaps they were hopeful to be in a better position two weeks before the midterm election. Must be why they didn’t file litigation regarding the Alaska ballot until now.

Ranked-choice voting and the names on the ballot both individually would make this totally specious.

This not the 1st time 2 candidates have almost the same name.

And couldn’t the Democrats, in particular Mary Peltola, file a suit that if Daniel Sullivan wins, the results are invalid because they were confused by the two and meant to elect the other Daniel Sullivan, not the incumbent.

It begins.

If I was a Alaskan Republican voter I would vote D just because Trump decided to tell me how to vote. But again Republican voters value their tribe more than anything and as we seeing in Ohio, they will take the side of a woman that allowed her daughter to be raped.

That’s not how ‘typical’ courts work - you made an accusation, it didn’t pan out. Enough said.

Anyone have anything reputable?

The current senator literally has “incumbent “ by his name on the ballot.
