Or subpoena the transcripts and/or videos themselves. I don’t think the Speech or Debate clause would cover that. The critters are off limits.

I worry they will get them and then demand that they don’t make them public because of ongoing investigations, and then nothing comes of those investigations.

(from the Wheeler article) The discovery deadline for the Proud Boy case is tomorrow. If DOJ put Bertino before a grand jury and he said something that conflicts with what he told the Committee, it could doom his reliability as a witness, and with it the Proud Boys case, and with it, potentially, the conspiracy case against Trump.

If DoJ needs transcripts of Bertino’s testimony to the Jan 6th committee, why can’t they subpoena just those transcripts?

I’m no lawyer, but I think you’re correct. What I’m annoyed by is even the hint of DOJ pique. It gives the perception of disarray. That’s one of the last things we need. What we NEED is a united front.

Small divergence between versions, quite normal in humans, could be used to some effect in impeaching the witnesses.

How does a need for timely access to Bertino’s testimony translate to a request for every single witness’ testimony (there are 100s if not low thousands of witnesses)?

the Jan 6 committee does not trust the DOJ, at least not to prosecute this vigorously, so they’re applying maximum public pressure through these hearings, then they can pass it all along

its been like 18 months, DOJ can wait one more week
