U.S. appellate judge Merrick Garland pushed the Justice Department to the logical extremes of its defense of President Trump by getting a DOJ lawyer to say that Congress couldn’t sue if an administration on its own decided to pay for uninsured people’s health care.
While kinda funny to see, conservatives will just change their minds as soon as it’s convenient for them to do so. Trumps DOJ will make the exact opposite claim as soon as they need to.

So if I’m reading this correctly the President as Chief Executive can take all the monies that Congress authorizes, which they have authorized for specific agencies, he can just take all moneies and spend it on golf?
Every single time the issue of a check or balance on Executive Power comes up in court, Republicans roll the tape: “Of course there are checks and balances on Executive power, your honor. Just not these ones.” Left unsaid: Republicans have already said the exact same thing about all the other ones.
The instant a Democrat is sworn in to the Presidency, Rs change out the tape: “Of course there are limits to Congress’s power to check the Executive, your honor. Just not this one.”
This is a charade, unfortunately. Nothing will get decided until the Trump Court has its say. Intellectual honesty is the bedrock of a properly functioning judiciary, and the Federalist Society, which now owns almost half of the judiciary, essentially programs and incentivizes Republican judges to brazenly apply double standards to advance the goals of the GOP. Our judiciary has been rotting before our eyes.
Hey Jill Stein and Gary Johnson voters, and Berniebots who voted for Trump. Imagine if you voted for Clinton in 2016. You’d have Merrick Garland on the Supreme Court. You purity trolls and self deceiving idiots are why we are saddled with the current right wing SCOTUS majority and Trump.
