After the acting U.S. Attorney of D.C. suggested that the Justice Department was not putting off-limits the speeches made by President Trump and others Wednesday that egged on the violent mob at the Capitol, DOJ officials played down the possibility that they might bring charges for those remarks, NBC News reported Friday.
It’s really not worth thinking about the legal implications until Trump is escorted out of office. That’s why all the fun lately, because of how dramatically the picture changes.
Sure, makes total sense, let those among you that have not been involved in actively attempting to violently overthrow the US government heave the first stone.

If the argument here is that the President’s pre-riot speech is prosecutable, there are some pretty significant First Amendment issues that may render prosecution unlikely. To wit, speech that’s considered “incitement” isn’t protected, but as a practical matter, the bar is pretty damn high, and rightly so.
