Walker is running for a 3rd term so I wonder if being held in contempt of court would sit well. I guess we will know by Thursday.
This is why we need an independent, impartial judiciary, without it undemocratic actions like this will increase in frequency. That’s why Republicans are pushing so hard to upend the judiciary and install people who will rule based on their political affiliation and beliefs instead of the law, as it’s the only way Republicans can continue to hold power. The stuff they have been doing is going to get overturned as long as the judiciary can continue to rule based on the laws.
This is why it was so critically important to have Clinton and other Democrats elected, because they would have placed those kinds of judges on the bench. I hope the lesson was learned, and liberals don’t fall into the “not good enough!” trap again…almost anyone on the liberal side is far better than almost any conservative who would replace them.
The proposed new law, in addition to being a travesty for so many other reasons, implicitly rewards unlawful conduct. Usually when there’s a conflict of laws that’s taken into account, no?
But what can a judge do who finds Walker in contempt? He deserves to be confined in the general prison population until november, but I doubt that can happen.
Wisconsin judges are very generous.

This is about as close as a judge comes to “Hey, assholes, we meant it, dammit!”
Pesky law. Damned pesky laws. Another compelling reason we need martial law now!

I don’t think so. The judge said today that, regardless of whatever law is made during the extraordinary session, Walker must announce election this week. The specific timeline was of particular importance to Republicans for that reason, as I outline above.
Let’s be clear.
The republicans know they cannot win elections without cheating or depressing voter outcomes.
There are more who are able to vote who believe in Democratic or Progressive ideals than republican philosophy,
so the R’s know they have to suppress votes to stay in power.

And Iowa is right behind them, heading for the ditch.

There is no way it can be constitutional for the state to temporarily deprive citizens of representation contrary to existing law, then turn around and leverage the state’s illegal disenfranchisement to more effectively disenfranchise those citizens.
I’d look to the Equal Protection clause for this, but I do believe ex post facto is relevant as well. Here’s why:
Ex post facto is implementing a common principle that says “citizens must be able to rely on what the state tells them”. Your cat tatoo business example expresses this. A stronger example would be a developer who’d obtained building permits and begun development in compliance with those permits. The city or county cannot come along after the developer has expended millions of dollars and say, oops, we made a mistake. You have to stop developing and forfeit your investment. The developer has to be able to rely on the permit process that the government put in place. More fundamentally, the use of legal precedent in the justice system is predicated on this principle of reliance. A court cannot arbitrarily and capriciously ignore or discard prior court judgements because citizens will have already relied on those determinations when making business decisions, investment decisions, and decisions about where to live.
The citizens in the affected counties will have relied upon Wisconsin law assuring them of continued representation when they chose to reside in Wisconsin. To yank their right of representation out from under them violates this principle of citizen reliance that’s the basis for all ex post facto articles of law – as well as being a fundamental principle of our entire legal system
