If they do it, it’s legal.
Until someone who actually cares about what is legal stops them.

She doesn’t know. She can make an informed guess and could probably get a jury to agree with here. Also, as excuses went it was a pretty transparent one (and probably capable of being disproven), so she may be confused why they didn’t come up with something better.
Yes, she seems very reluctant to give over to speculation.
