Discussion: Workplace Retaliation Suit Against Rep. Tammy Duckworth Settled

The simple truth is that if Tammy Duckworth was innocent, she would not have settled this case. Instead of taking the stand and testifying, Duckworth has chosen to stay silent and settle the case at taxpayer expense in order to hide from the truth.

… says a person who doesn’t understand why cases get settled. Continuing to defend the suit would have chewed up more than $26k in very short order.

And BTW, the plaintiffs wouldn’t have settled for their litigation costs if they genuinely thought they had a case. They ended up with, in effect, nothing (other than rendering themselves unemployable going forward).

This is exactly right, misterneutron. As a lawyer who represents plaintiffs, I can tell you that $26k is simply zip. The plaintiff will get nothing from this and the lawyers will get some of their out of pocket costs back, but likely nothing in attorney fees. This is a nuisance settlement, plain and simple.

This was a nuisance lawsuit against Duckworth. There was NO evidence she did anything wrong. I agree-- if the plaintiffs had a case, the settlement would have been bigger. I had even forgotten that she was involved in a lawsuit, because it’s not been news here in Illinois for years, mainly because the lawsuit was dismissed at least once due to lack of evidence.

On a different point — the photo of Duckworth leaving her wheelchair to participate in the House Dems sit-in in election platinum. Kirk has zip.

It would have cost an arm and a leg to battle this in court, and that was beyond her means.

Yes, because wasting more than $26,000 dollars to continue the case when the settlement makes clear that Duckworth didn’t break the law makes soon much more sense for those fiscal discipline Republicans who also hate frivolous lawsuits.

Very ignorant logic for very ignorant people. Kirk knows all too well these two employees will receive absolutely not a penny. This “settlement” was purely for court/lawyer costs – and nothing more than the lawyers’ actual costs, it seems, meaning not much (if any) profit for them. If these two people had anything, they wouldn’t have finally settled to receive … zilch. That’s also why the lawyer agreed to these terms. Kirk is a dumb-ass for trying to throw this in Duckworth’s face.

And just like a Republican like Kirk to lie about it.

“Dumb and Incorrect” is actually Mark Kirk’s campaign slogan. He used to be thought of a fairly moderate, business Republican. Then he went to the Senate and became just another nut-for-hire to whoever would get him reelected (see also: NC’s governor, Pat McCrory). Shame. Tammy Duckworth, I also have issues with - like her single-minded obsession with getting herself elected to higher office, which squeezed out other Illinois Dems who had been in the party for years, toiling away, only to have War Hero Tammy ™ swoop in and get put at the front of the line. But, at the end of the day, I would swallow hard and pull the lever for Duckworth over a venal suit like Kirk.
