doesn’t Scalia’s argument work both ways? wouldn’t she be too slow to go to the Big Kid’s school since she couldn’t qualify for entry under the 10% requirement?

or does that only apply to black folk?

Wilmore makes a great case that this suit is wholly without without merit.

Essentially, Scalia’s argument is irrelevant because of that. She is in the same boat as the minority that did get accepted, and in that light, its questionable that she should even have standing. Both students have roughly the same academic record, so it would seem to come down to does UT have an interest in promoting a more diverse student body…and the answer is yes.

Which is why Roberts offered up his argument…that a black person doesn’t offer any more to a physics class than a white person. I understand the outrage, but Willmore’s example here is actually off target. Roberts didn’t say black people aren’t smart…he is asking, what difference does it matter what color a person’s skin is in a physics class?

And the answer is that people of different ethnic background bring different perspectives to the same problem, by which other people learn. So the black guy pulls upon something in his background/experience to solve a problem, and the white girl learns to look at things differently. And vice versa.

You know, sort of like having Jewish, Italian, Hispanic and Black people on the Supreme Court helps them all see things from different perspectives. Naaa, its quite obvious that hasn’t worked in Roberts or Scalia’s cases.

Yes, but her skin is very fair, so she should get everything she wants, always. That’s the Supreme Court’s thinking, I’m betting.

The one who whines that the Affirmative Action that got him into Yale, made it difficult for him to find gainful employment upon graduating from law school? As he sits on the Supreme Court with a lifetime appointment, a SCOTUS made up entirely of Yale and Harvard grads?

Was he even awake during the oral arguments??

Interesting.

I have long been someone who has lectured about syncretism. In the cultural sense, it means that A + B + C= D.

The United States is far more varied than Mexico or even the Caribbean. The fact that “racism” is still a factor in our society is a tribute to the inventiveness of those who benefit from that “racism”.

What you are suggesting is a natural process and can be adapted to syncretic analysis. My consciousness (among other things, born of a syncretism of Mexican and American-Service-kid-childhood influences) cannot be linearly evaluated in the manner that the Italian-American Scalia would prefer.

That is rarely the case in human interactions because of some level of synergy. How much synergy varies in each situation, and sometimes it can even be a negative modifier. But it is almost never linear.

If you really think about it, its homo-sapiens defining quality…that working in groups is more productive than working alone. Its born out in genetics, economics, warfare…just about every human endeavor. Which may be why tribalism developed, as sort of a natural counterweight to such a massive advantage.

Or maybe it’s because he graduated in the middle of his class from Yale. It’s exceedingly tough to get your first job as a lawyer outside of the top 20% of a class. But people deal with it and get jobs. That said, it must not have been that difficult. He graduated in 1974 and was appointed an Assistant Attorney General in MO the same year. So whatever.

168 black and Hispanic students with BETTER grades then she had did not get admitted either. But no one seems to care about them.

She ended up going to LSU. No idea what she does now, but I wouldn’t be surprised if she makes a living on the grifter circuit.

BTW, the second-previous chief justice was Burger, not Berger :wink:
