Really. That was excellent.
It isn’t just us crazy feminists redefining rape. The state of Kansas, where I currently live, defines rape in legal terms as occurring when a woman is too drunk to say no.
I’m no lawyer, but I’m guessing that these extra-legal, non-judicial, non-jury, “trials” conducted by college administrators will be a real can of worms.
The college has no subpoena powers, but can make a decision based on the “preponderance of evidence,” not reasonable doubt.
Who will submit to such a “trial”?
We’ll see some lawsuits by students “convicted” in these cases just as sure as God made little green apples. It will turn into a circus to be sure.

At this point, rape culture is pretty much like evolution or climate change: the wingnuts are talking to one another with no clue to how laughably yet dangerously crazy they sound to the normal people around them,
The actual “can of worms” in the real world is the long, long history of college administrators discouraging or ignoring reports of sexual assault on their campuses, including situations with multiple independent reports involving the same rapist.
It seemed like there was an upswing before the 2012 election of Repubs comparing all sorts of things to rape – Obamacare, etc, etc – while they were downplaying actual rapes. Given how much some of these guys confidently talked about what wasn’t “real rape” and how women somehow magically never got pregnant from “real rape” and so on, I started to wonder how many of them were simply trying to define rape in such a way that they themselves weren’t “real rapists”. Creepy.
ETA: Also, rape culture is such that a lot of “normal people” are oblivious of their own participation in it.

Well I am a lawyer. Your concerns are likely spectacularly overwrought. In such an administrative hearing, the student isn’t “convicted” of anything. As with all other college administrative hearings that have been occurring since time immemorial (like cheating, throwing cherry bombs out of your dorm room, cold-cock punching someone in the face, etc etc), a number of outcomes and punishments are possible—the worst of which is dismissal. We are only giving greater attention to a serious problem that has been ignored or minimized for too long.

There is regrettable sex, there is drunk sex and there is regrettable drunk sex.
There may be even regrettable, drunk, mutual rape.
But, trying to blame one or the other of the two horny and/or drunken parties for regrettable, mutually drunken sex, is next to impossible.
The predators, on the other hand, are what they are. Rapists on the prowl. You gotta catch these bastards, not blame others for the crimes of sexual predators.
