Discussion: What Scalia’s Death Means For SCOTUS' Blockbuster Immigration Case

For all those who have a problem voting for either Clinton or Sanders…this is what your vote should be about…the SCOTUS.

Every other issue could wind up for some reason or another in front of the Court. It does matter who gets to pick the nominees. Our best gift to this country would be to take back the Senate, and work on getting the House back.

But this would still be better than if Scalia were alive. The future would be still up for grabs on the issue, rather than another lousy GOP law enabled.

We live in a world where you can’t even make a good slippery slope argument any more. Even the most carefully crafted sarcasm, or the most obvious, transparent reductio ad absurdum is prone to some dumb ass throwing down and trying it like a personal dare.

So this issue of standing is far more important than anything to do with immigration. On how flimsy a pretext can state officials sue to impose their policy preferences on everyone? It doesn’t get much flimsier than Texas predicting they might wind up issuing more driver’s licenses.

Standing is a tool that conservatives use when they want to dismiss a suit that would yield a liberal result, so I’m not sure they would go for it in this case.

I’m quite curious in the interim here to see how much the lack of ‘bully’ influence of ASS might see some cracks in the blockade in addition to simply being the 1st vote in favor for anything that smacks of bigotry or hatred.

I don’t want to sound cruel, but this nation is so much better off with that man dead and in the ground. The benefits are already showing themselves.

Overall - not just on this case, but any future cases that come before the court - I’d say that the chances of civilized society winning have gone up with Scalia not on the bench.
