I wonder whether the trump administration’s insistence that their decision is unreviewable ultimately hurts their case, because it’s so obviously false. I wouldn’t be surprised if the appeals court sent the case back down, with an order to the government to a) produce a detailed policy instead of the changing-every-other-day mishmash they’re trying to defend now and b) make an argument about why it should survive at least a cursory review.
