A modest idea: Trump’s current business activity clearly involves receiving “emoluments” (a salary, fee, or profit) from interests, public & private in foreign states. Such activity for a President is in clear violation of Article 1, Section 9, Clause 8 (the Emoluments Clause) of the Constitution. Trump continues to assert that he will not cease his business activities upon becoming President. Thus, as soon as he takes the Oath of Office he will be in clear violation of the Constitution and his oath to “faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”
Given that under these circumstances, the instant he takes the Oath he will be violating it, can Trump be legally sworn in and granted the Presidency?
