There’s an element of GOP dirty trick in this. The issue they’re playing in that bill is one that sets well with a majority of the American people. Immigrants are not the parasites they’ve been painted to be but that picture has been successfully painted so it would be a good idea not to play into the trick. The time to attack this thing is AFTER the election. If progressives want to keep their momentum going they should stay mum on this Stephen Miller piece of shit bill. Win then sink it.

The press makes it sound like Trump administration only opposes illegal immigrants. The truth is Deputy Reich Fuhrer Stephen Miller hates all immigrants, legal and illegal, and his administration is doing everything possible to make life hard for legal immigrants.

Next they’re going to make non-European immigrants who are already citizens and can’t be deported wear something identifiable, like, oh, a yellow star or something.

Given the amount of public assistance farmers receive, any immigrant who is a farmer or works for a farmer should fall under this proposed provision. I suspect our farm aid far outstrips welfare aid.

It’s not a bill, it’s a proposed regulation from Our Good Friends at DHS. It will be published in the Federal Register and then receive a 60 day open comment period. After that, the agency will review the comments and modify its regulation (if necessary) and publish the final version in the Federal Register. Congress isn’t involved at all except as GOP cheerleaders.

So it’s a product of the regulatory state that the GOP and Trumplicans hate so much and want to dismantle.

The good news is this: because of the timing, the next Congress can kill this piece of shit. We have to take both the House and Senate to do it, but if we do control both houses this should be the first priority.

You are absolutely right, and one easy way to kill it if the Democrats take the House is by simply adding appropriate bill language that prohibits the use of federal funds to adopt or enforce any such regulatory change.

Having said that, I was disappointed in the weak - hand wringing - responses of the immigrant rights community quoted in the NYT article. There is nothing in the federal laws establishing these programs that in any way authorizes any such differentiation; the specifics of these long-standing laws must constitutionally supersede any general “public charge” language in the immigration laws, which do not, in any way, even reference these specific benefit laws. If any such differentiation is to be made, Congress must do it through the enactment of new law. Even if Congress were to enact such a change - which is not going to happen - the attempt to deny any generally available governmental benefits to taxpayers holding a green card would be automatically open to a strong constitutional challenge under the Due Process and Equal Protection provisions of the constitution.

But if friends of the immigrant community really want to make sure that this despicable, politically motivated and timed proposal never goes any further, there’s only one thing they have to do: vote.
