Discussion: US Appeals Court Won't Immediately Allow Trump Asylum Ban

Jay Bybee?

The Bush Assistant AG who signed off on the John Yoo torture memos?

And he thinks this is an overreach?

Can’t wait to see Trump’s nickname for him …

(And since when is Nicole writing AP stories?)

If my batting average was as low in my line of work as Trump’s is with the courts, I’d find another line of work.

At issue is President Donald Trump’s Nov. 9 proclamation that barred anyone who crossed the U.S.-Mexico border between official ports of entry from seeking asylum.

CBP is blocking ports of entry, forcing asylum seekers to cross between ports of entry, and, of course, Trump is trying to prevent that as well. All of this in contravention of US and International law.

So these poor immigrants fleeing violence, corruption, and criminal activity have no place to go. Seems like there may be a parable about that somewhere…

I’ll say it again:
Trump wanted show down now he’s got a show down. The crisis at the border is his making, and hopefully his undoing.

“We’re going to win so much. You’re going to get tired of winning. You’re going to say, ‘Please Mr. President, I have a headache. Please, don’t win so much. This is getting terrible.’ And I’m going to say, ‘No, we have to make America great again.’ You’re gonna say, ‘Please.’ I said, ‘Nope, nope. We’re gonna keep winning.’"

Yes, I did an OMG myself when I saw that Bybee was the opinion’s author. It shows just how far we have sunk under Trump that a pro-torture guy thinks Trump is flouting the law.

So I wonder what the dissenting reasoning is. The section of the law that I’ve seen cited doesn’t seem to have a lot of words. (I guess you could argue that breaking the law to enter the US makes you ineligible for asylum, but that’s a huge stretch, and even more of a stretch when lawful entry ports are being blocked. Of course, they could just arrest all the people involved in the conspiracy to block the entry ports…

neither may the Executive legislate from the Oval Office

Charles Koch intends to change that.

It’s much easier to buy and control a single king than 538 members of congress.
