Discussion: Trump's Lawyer Argues He's Immune From Lawsuits In State Court As Prez

Yeah, but it might cut into his job as executive producer of “Celebrity Apprentice”.

This is absurd. If the President is subject to federal lawsuits, I fail utterly to see why he is immune from state lawsuits.

The President is not immune from the law on any level.

Gorsuch may be in by then. Then all bets are off.

This lawsuit was deliberately filed before he took office.

Trump’s lawyer’s on really shaky ground here. Not likely he’ll be able to get this one thrown out of court.

Sovereign Immunity? Really? I’m pretty sure that’s not how it works here. Yet.

“My best guess is that the NY state court will not dismiss on immunity
grounds, and the question will eventually end up at the US Supreme
Court,” Sherry wrote.

Can an attorney here weigh in on this? I thought the only way SCOTUS would hear a case from a state court is if the case involved a constitutional question. Since the relevant constitutional question has already been answered, I don’t see how this gets beyond the NY Court of Appeals.

I read that last word as ‘immaturity.’ The only reason I caught my mistake was because you preceded it with “alleged.” I am watching his hypocritical presser now and he is saying that nothing should be produced overseas. He who imports all his goods from China. He just said he insisted that the pipeline be built with American steel. I just read last week that it had already been purchased from Russia.

What a shit! I hope he goes down soon!

“In Jones, the Court suggested that a civil suit would not occupy too much of the president’s time. Yet Clinton v Jones led directly to Clinton’s impeachment. Given that history, one might predict the Court would be reluctant to allow more civil suits to go forward during Trump’s term in office,” Winkler wrote in an email.

Because, you know, IOKIYAR.

Let’s hope not!

Just because a person has the clearance does not convey the “Need to Know.”

This is basic stuff, so why are Donnie’s staffers stepping on their own dicks?

Jones v Clinton was a unanimous decision.

Majority: Stevens, joined by Rehnquist, O’Connor, Scalia, Kennedy, Souter, Thomas, Ginsburg
Concurrence: Breyer

Even Clarence agreed!

Delay and distract…it’s all he’s got. Oh, and apparently enough money to employ an army of lawyers. Putin must have him on a pretty big allowance.

Yes, but that’s because the “liberal” wing actually believes in the rule of law. The conservative wing only believes in applying the rule of law to non-Republicans. Thus, 4-4 (assuming it gets to them before Gorsuch)

Double standard much?

He would like to think so for sure. However, given no other president has had these conflicts of interest either. It is hard to say. As most presidents are not even appearing that they are directly gaining personally while serving. Trump is making money off the taxpayer from the get go.

Just protecting his wife and his frequent trips, if the pace keeps up, would cost around 400 million or more. A year, or 1.6 billion over four years. Obama was 96 million for 8 years.

4-4 until Blinky Gorsuch gets confirmed.

Occupy a lot of the …person’s time? Seriously? So het miss a golf game or 2?

there’s a chance a court could dismiss the case because it could occupy a lot of the President’s time

And POTUS’s time is certainly precious. He’s trying to shave 2 strokes off his long game before he’s impeached.

(Thumbs thru Copy of Constitution, stops at Article VI clause 2…) I don’t see how citing the supremacy clause in any way can be interpreted to mean that the President is immune from lawsuits. The document says that the Constitution and the laws and treaties made pursuant to it are the supreme law of the land. That has nothing whatever to do with trump’s immunity togroping an Apprentice contestant before he was in office… So sue him!!!
