Martin told the Wall Street Journal that she was representing Cohen’s company, Essential Consulting, LLC, “in her individual capacity” until the main lawyer on the arbitration received permission to practice in California.

In retrospect, she probably should have taken off the red “MAGA” hat at the hearing.

If she were representing him in her individual capacity (and I’d want to see billing records to reflect that), wouldn’t that be a serious ethical breach without the permission of the third ostensible party to the agreement, who is also her employer?

So of all the attorneys in California, it just happens to be this one whose place of business is at One Trump National Drive, who was available to do this? For lunch money, you could hire a lawyer as a stand-in until out-of-state counsel got their required approval. And why not just hire a California law firm? This is how weird, sketchy family businesses operate.

Because clearly there are no lawyers in California EC could have hired to do that. California’s critical lawyer shortage is well-known. And that’s why an in-house lawyer for Trump’s front holding company had to be called in from NYC. She was the only lawyer with a licence to practice in California availible, so out of the the goodness of his heart, Donny Jr. authorized her to take a paid leave of absence and go represent this totally unrelated party in a matter Trump and the Trump organization have absolutely nothing to do with notwithstanding what the White House Press Secretary said.

This is all perfectly normal. And totally not a breach of her ethical duty not to tell lies about cases she’s involved in when dealing with third parties or tribunals.

Well, isn’t Cohen the third party to the agreement? He set up the LLC, he was the one who signed the agreement and he was the one who provided the money for the payment.

Oh yeah…that’s all true, but then Cohen would have no legal basis to create or enforce a NDA that protects Trump and not himself. :wink:

Although he didn’t sign, trump is listed (through an alias) as a party to the agreement. It seems that he keeps arguing that he is a party to it for purposes of enforcement against Daniel but not a party to it for purposes of any litigation against him. Which is nice work if you can get it.

What blows my mind, is there are still people in the media calling it an “alleged affair”. Because its totally normal for a Presidential candidate to secretly draft NDAs with random women that he didn’t have an affair with, and give them 6 digit pay outs.

That’s why campaigns are so expensive, I suppose. :smirk:
