That was a different issue. The constitution calls for an “enumeration” -

“The actual Enumeration shall be made
within three Years after the first Meeting
of the Congress of the United States, and within
every subsequent Term of ten Years, in
such Manner as they shall by Law direct.”
(article 1, section 2)

The argument was made that adjusting the “actual Enumeration” was not constitutional.

The issue before the Court now is can for political reasons the cencus be changed to try to reduce the “actual enumeration” by certain groups. Ross was clearly busted lying (showing bad intent) and my guess is the Court for several reason is going to order the question be dropped.

“I have seen the public analysis and the presentation of options that were part of the decision making, and I am aware that there’s a number of views with regard to potential impact, possible impact,” Dillingham said.

Adding, “I like beer, I still like beer.”

He DID answer, without ever having to say a word. He wouldnt be Trump’s nominee for director of the Census Bureau if he DIDNT think the question should be allowed.
