Discussion: Trump Lawyer Apologizes For Saying That 'You Can't Rape Your Spouse'

Discussion for article #238841

Beautiful apology as apologies go in this age of blurry PR and fraud and it will serve as an effective parry to the various killing thrusts over the next few days as we await the Donald to opine on this heavy matter of state…

but the gall of this particular reporter to make such a reprehensible and false allegation against Mr. Trump truly stunned me," Cohen said in a statement to CNN.

Dude! The story quotes decades-old testimony by then-Mrs. Trump that is public record.

I’m sure Ivana cannot speak ill of Mr. Trump now due to divorce settlement and alimony dictates. But, that stuff wasn’t just made up out of thin air by the reporter.

Trump certainly knows how to hire 'em.

“I think your paper’s a joke.”

Says Ringmaster Cohen, while the calliope plays, and the tiny car enters the center ring.

The GOP Clown Car, no doubt.

“You’re talking about the frontrunner for the GOP, presidential
candidate, as well as a private individual who never raped anybody. And,
of course, understand that by the very definition, you can’t rape your
spouse,” Cohen told the Daily Beast. “You cannot rape your spouse. And there’s very clear case law.”

OOPSIE!!

Pick your state sir.
New York?
Marital Rape
In New York, rape occurs when the defendant compels a victim to
engage in sexual intercourse against the victim’s will. The crime is
broken into three categories:

Rape in the first degree occurs when the defendant
forced the victim to have non-consensual sex, or the victim was
physically helpless and unable to consent.

Rape in the second degree occurs when the defendant
had non-consensual intercourse with someone who is incapable of giving
consent because of a mental disability or incapacitation.

Rape in the third degree occurs when an adult has
nonconsensual intercourse with someone who is capable of giving consent,
but who did not consent for some other reason (such as being threatened with force or violence).
(40 N.Y. Con. Laws Ann. § 130.25, 130.30, & 130.35.)

Penalties
Penalties for sexual assault depend on the circumstances of the
crime, and New York’s sentencing structure may include the following
prison sentence ranges, with increased penalties for defendants who have
prior criminal convictions.
Rape in the first degree is a class B felony, and penalties may include a fine, up to 25 years in prison, or both.
Rape in the second degree is a class D felony, which may incur a fine, up to seven years in prison, or both.
Rape in the third degree is a class E felony. Penalties may include
probation, a fine, up to four year in prison, or some combination
thereof.

No, Cohen’s reaction, I’m guessing, could be fueled more by the heat and embarrassment of being angered and entrapped by the old quote by the nervous, very youthful, non threatening news nerd, identified as the reporter on CBS this morning, if Mr. Cohen is the type of billionaire-employed attorney Manhattan is known for?

Because I think you’re an idiot.

Both lawyer and client have nothing but contempt for those they speak to.

Exactly, marital rape has been defined law in all states since 1993. I can’t understand why that is not in this article? Technically, prior to that, in some states, a man could not legally rape his wife, it was referred to more as a sexual assault. And THAT is the whole point of this, he could have made that statement in such a scenario and he would have been legally correct, but that scenario has not existed in the US since 1993. So this LAWYER botched the LAW. That is the whole issue.

A little OT but Paul Krugman is weighing in on The Donald with accompanying images and he sounds a little alarmed. Maybe we all should be.

Cohen said that legally, “you can’t rape your spouse.”

Since, ya’ know, women are legally property and have been in traditional marriage since before the damn liberals started the descent into the abyss with the whole ‘women’s lib’ movement. Husbands have to go to work and wives have to put out, that simple. If the husband makes a lot of money, then the wife should hold up her share of the marriage.

You know, a guy who’s literally stunned into incoherence by hearing a false allegation made might have too gentle and idealistic a nature to practice law.

“In my moment of shock and anger, I made an inarticulate comment - which I do not believe – and which I apologize for entirely.”

Not buying your bullshit for a second sparky.

my absolute pleasure to serve you with a $500 million lawsuit

Will this be like suing Bill Maher for saying your client was the result of his mother mating with an orangutan that got dropped?

Ummm

Trump apologizes for saying you can’t rape your own wife.

is a bit misleading, yes?

Now we see the problem. Trump was getting bad legal advice. Trump never would have raped his wife if his lawyer had warned him that it wasn’t legal. Trumps only option is to fire his loser of an attorney. I’m sure the Trumpaphiles will buy that explanation…

Now: “I made an inarticulate comment - which I do not believe… Earlier: …Cohen told the Daily Beast. ‘You cannot rape your spouse. And there’s very clear case law’.”

It is not merely “inarticulate” when you say "very clear case law " backs it up. It is a core belief. So his apology is BS, probably offered under threat of being fired by Trump.

A seven or eight hundred dollar an hour lawyer threatening legal action and expressing outrage that the press would dare question Trump’s integrity based on sworn deposition testimony ought to apologize to the entire profession for being a complete dumbass and refund whatever his client has paid him.
