Speaking of holy scripture: one of the names being bandied about as a replacement for Scalia is Sri Srinivasan, who’s a judge on the US Court of Appeals for the District of Columbia Circuit. As per his wikipedia page:

“His Senate confirmation hearing on April 10, 2013 was uneventful. His nomination was reported to the floor of the Senate on May 16, 2013, by a unanimous vote of 18 ayes to 0 nays. A final vote on his nomination took place on May 23, 2013, where he was confirmed 97–0. He received his commission on May 24, 2013. He took the oath of office before Chief Judge Merrick Garland on June 18, 2013. At his swearing-in ceremony, he took the oath on the Hindu holy book Bhagavad Gita.”

The Evangelical Christianists who dominate the GOP aren’t going to be happy about that last item!

I haven’t found anything definitive about what his jurisprudential leanings are, but from a purely partisan political standpoint, it would be smart for Obama to nominate him. Since the GOP didn’t cast a single “no” vote at any stage in his nomination process, it would simply highlight how opposition now would be purely political in nature.

On top of that, Republican refusal to allow the nomination process to take place for the first South Asian American nominee in history would further weaken its standing among Asian Americans, the fastest-growing minority group in the US today. Since the GOP has already effectively destroyed its standing among Hispanic Americans, Obama and the Democratic Party should encourage the GOP to do the same with Asian Americans.

• Edit: My political scientist brother just pointed out a big ol’ flaw in my plan:

“…there is a definite downside: if he leaves that DC Court of Appeals, that would weaken the Democratic majority on that Court by 1 vote, and there is no way the GOP is going to approve another Democrat for that Court. The reason it is so important is that this particular court handles ALL federal regulatory matters, and it is really vital that Democrats continue to control that. It was only relatively recently that Obama was finally able to get a Democratic majority.”
