The NDA’s they forced Government Employees to sign are unenforceable on their face as they DON’T WORK FOR TRUMP, they work for the United States Government, which bars these kind of agreements in red-letter law.

It sure would be nice to have some discovery here. The precise terms of the NDA, the names of everyone who was asked to sign, whether anyone was denied a job for refusing to sign (which I would think could bring up criminal charges). Then the NDA can be declared against public policy.

Not exactly. Sims book also covers the campaign, during which none of them were government employees. But given the crappy construction of other Trumpf NDAs we’ve seen it could easily be unenforceable.

I think they’re bluffing.

I don’t know anything about the technical details of this NDA (what state’s law would apply, was their consideration for the NDA, etc) but arguably, such an NDA is against public policy. If the Trump campaign picks this fight and loses, they invalidate all their NDAs in one fell swoop. That is a lot to lose.

Counterpoint: if they don’t enforce it, than everyone thinks they won’t enforce against them,…
