Hey, if undocumented immigrants AREN’T subject to US jurisdiction, that’s a real game-changer which I’m not sure POTUS has truly thought all the way through.

(Of course he hasn’t.)

I mean, ICE is gonna have a whole lot less to do if all the folks here illegally aren’t subject to US jurisdiction. Just saying.

I think the “many legal scholars” Trump is talking about are Gorsuchs and Kavanaugh.

All it takes to override the Constitution is an executive order and a compliant Supreme Court.

Seems like an unforced error, IMO, if this was an election ploy. This isn’t going to motivate anyone in his base to vote who isn’t already voting. Plus if he’s gonna do it by EO, he doesn’t need Congress, governors, etc.

While Kavanaugh, Gorsuch, Alito and Thomas probably would go along with this, I cannot imagine Roberts would. I just can’t. I may have fundamentally misread the man, or be falsely hopeful to preserve my sanity, but I don’t think he would.

The only people it would seem to motivate would be the (few) “moderate R’s” who were gonna hold their noses again, especially POC who vote conservative - they may not vote D, but this may piss them off enough to stay home. I think about people like my parents’ friends, who are Indian immigrants and vote R for tax cuts and because they’re a bunch of judgmental, moralizing harpies. I am making sure to remind all of them that no birthright citizenship means THEIR kids would not be citizens.

Also, this (theoretically) could motivate Dem base more - many of us are children of immigrants and can imagine being affected by this.

That said, it is absolutely terrifying that our media is treating this like something he could potentially have the right to do, and trying to analyze it as a legal question, in the name of “both sides” coverage. Kai Ryssdal and Molly Wood we’re right the other day - when the history of this time is written, the media is NOT going to come out looking good, with a few exceptions.

But just for the record, one of the “other” ways will not be by Executive Order. He is truly unfit for office in that he has no real understanding of his Constitutional powers, only his ability to share his ignorant opinions with the world via Twitter. Then again, I think that’s mostly why Twitter exists, and not just for him.
