Evidence that he’s an assh*le shouldn’t really be part of this trial. Evidence that he has a long pattern of engaging in legally, uh, reckless behavior seems relevant.

LOL. The judge is never going to grant a motion in limine to exclude statements that came out of Trump’s own mouth that are inconsistent with anything he’s saying on the stand or claiming in the case or which constitute admissions by a party. Those are exceptions to the hearsay rule…but do keep in mind that statements made outside of court usually are excludable as hearsay. Anyhoo, if I was the plaintiff’s attorney, I’d already have a cross-examination outline littered with his own statements so I could make him squirm and eat his own words like a good boy.

As for things said by surrogates or Trump’s nastiness towards the judge, that will likely stay out. Katrina Pierson belching idiocy or Trump talking in a derogatory manner about the judge really have nothing to do with the substance of the case.

Maybe…it’s pretty tough to get someone on that actually. People “fib” on the stand all the time and judges don’t have them dragged off in chains. They just find that the witness isn’t at all credible and discount their testimony. It’s gotta be pretty egregious for perjury to come up. Trump is precisely the kind of client that would have me worried about it though haha

That would be inadmissible as prior bad acts unless very much tailored to showing he has a pattern of engaging in precisely the kind of behavior he’s been accused of with Trump University…fraudulent con schemes, etc. Lying in other ways or overly litigious behavior would probably still be too much like just attacks on character.

Trump lawyers must shiver every time Trump opens his mouth or writes a tweet, although they are probably getting paid well enough to make the heartburn bearable. And they have the advantage that Trump can’t weasel out of paying them… they know where the bodies are.

Yes, because that is what is required by the system of law that Trump doesn’t even recognize and which will be fairly applied by a judge who is a far better human being than Trump can ever dream of being.
