Donā€™t matter Iā€™m thinking. His image as a billionaire will be damaged and that would drive him insane. I donā€™t think he worries about prison as he canā€™t believe that is even possible.

They had to wait for the decline, and the suit takes time to prepare. Iā€™m more irritated that this wasnā€™t started on Jan. 4, so that weā€™d have been at this point in early March. It was always obvious they would do this.

Iā€™m aware of Kilbourn, and itā€™s important to point it out. However, the Secretary may run into a lot of trouble in trying to use it in this instance. First, the House Committee did state a legitimate legislature purposeā€“in fact, several. Unless the stated purposes are transparently frivolous, that would seem to end the matter. Also, Kilbourn was decided in 1880 and involved a private citizenā€™s confidential affairs. Weā€™re talking about the President here. The 16th Amendment (authorizing the federal income tax) wasnā€™t adopted until 1913, and stems directly from the the power of Congress to lay and collect taxes. The means by which income is reported and taxes collected are well within the purview of the relevant House committees. Next, 26 USC 6103 was first passed (I believe) in 1924, and has been amended many, many times since then. Thatā€™s a lot of history, amendments and rule making that never mentioned that the Secretary of the Treasury, as opposed to the person whose returns are sought to be disclosed, is the one who has standing to complain of the lack of a legitimate legislative purpose.

Speaking of NY state, didnā€™t they just pass a law allowing their AG to send Trumpā€™s state tax returns to the appropriate House committees? Does anyone know where we are with that?

Neal is in the House, not the Senate. There is no way McConnell will allow a subpoena to be issued by a Senate committee (Burr being the exception that proves the rule) and even less of a way that he would order the Sergeant at Arms to enforce it.
