"It's unconstitutional. He should be impeached if he tries it," Tancredo, a Colorado Republican and outspoken immigration hawk in the House from 1999 to 2009, said Wednesday evening by phone from his home in Denver.
US Constitution, Article II, Section 2, paragraph 1
he [the President] shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.
A blanket pardon is known as an amnesty, and is within the scope of the President’s constitutionally granted powers.
This is much the same thing as when Carter granted amnesty to Vietnam era draft dodgers. Carter’s pardon reads, in part:
Acting pursuant to the grant of authority in Article II, Section 2, of the Constitution of the United States. I, Jimmy Carter, President of the United States, do hereby grant a full, complete and unconditional pardon to: (1) all persons who may have committed any offense between August 4, 1964, and March 28, 1973, in violation of the Military Selective Service Act or any rule or regulation promulgated thereunder; and (2) all persons heretofore convicted, irrespective of the date of conviction, of any offense committed between August 4, 1964, and March 28, 1973, in violation of the Military Selective Service Act, or any rule or regulation promulgated thereunder, restoring to them full political, civil, and other rights.
Once again, Trancredo demonstrates that “constitutional conservatism” is the belief that anything that you don’t like is unconsitutional.
