The people have decided, the people want equality for all. Black, white, gay, lesbian, straight, whatever, the people want equality and fools like Byron Babione will find themselves on the wrong side of history just like the KKK did.
Well, however it turns out in the short term, I am still tickled to death to think of gays marrying in Oklahoma and Utah.
And in the long term, it’s a done deal.
If the justices were up in arms over same-sex marriage, they could easily have taken one or more of these cases. They don’t require a split among the circuits, that’s just one reason for taking a case. The not-so-subtle message to the Circuit Courts is that the Supremes are unlikely to overturn all of the rulings in favor of gay marriage.

So, do these Federal courts still have any legal basis to deny equal marriage?
As I recall, the dissenters have been using Baker v. Nelson.

Michigan is waiting for the 6th Circuit Court of Appeals too. Majority public opinion has been in favor of granting full marriage equality in the state for at least 4 or 5 years now. Hopefully, they’ll take that into consideration that public attitudes not only have shifted since 2004 when the ban became law, but that the unconstitutionality of that law banning same-sex marriage was in error, born of abject prejudice and ignorance.
I know a lot of small-town Americans and they, well, don’t seem normal to me. Maybe its all the spittin’ they do.
Heard the exact same thing in the late 60’s about interracial marriage. Bigots were wrong then, they are wrong now, and will forever be wrong in the future.
True story. Back in the 60’s I asked my mom what a homosexual was. Her reply was that it was a man who was half black and half white. Yes, she was a small-town American, bless her heart.
The people should never—under any circumstances—vote on people’s civil rights.

Do you mean the same ‘faith & values’ that was argued as the reason for why chattel slavery was continued for almost 100 years after the Revolutionary War and took the deaths of 600,000+ Americans to finally see it struck down?
Yeah, don’t mind me if I don’t care what people that think that civil rights should be by majority rule and should only be conferred by a vote. Civil rights are for everyone, whether you like it or not.
It depends on which judges are appointed to the three-judge panels hearing the cases.
8 of the judges on the 6th Circuit were appointed by Bush the Lesser, 1 by Bush the Elder, 1 by Reagan, 3 by Clinton, and two by Obama.
This, plus they really don’t want to have to decide this issue and get pilloried by whichever side they rule against. So they punt and hope that the remaining federal appeals courts and/or state governments do the dirty work for them.
