A deposition of an executive branch official of Ross’ stature is extremely rare. According to Politico, the last Cabinet official who was called to testify in a civil proceeding while still in office appears to be Interior Secretary Bruce Babbitt, who took the stand in a 1999 trial over funding for Native American programs.

I said before, and I’ll say again, the Orders to depose Ross are well supported in law. Other witnesses - and even DOJ’s written filings - make clear that only he has the answers, and the questions he needs to be asked are directly relevant to the claims before the Court. The order limiting the depo to 4 hours (rather than the typical seven hours under FRCP 30) reduces the burden. If the Supreme Court steps in, it is a nakedly political move.
And I might add that the record - via written documents - suggesting that Ross has repeatedly lied about his actions, which legally creates a presumption of improper conduct, is overwhelming

I presume that Ross’s answers about how the citizenship question came to be part of the Census survey will figure in any lawsuit aimed at taking it out again. It is refreshing to hear a judge say that “intent and credibility” of a public official can be tried in court. This certainly seems to be contrary to the usual course, sad to say.
