Discussion for article #228127
Only one thing is for sure: The conservative majority will do its level best to destroy whatever individual, non-corporate/1-percent rights it can before Nino Scalia chokes on a chicken bone, Clarence Thomas has a coronary while watching internet porn, or Anthony Kennedy succumbs to an infection derived from a splinter he got while sitting on the fence – again.
So they’ll get the chance to make life tougher for women, gay people, AND minorities? And give us two scoops of Christianity? All in one season? Samuel Alito must be cackling like Woody Woodpecker right now.
If I were Obama…
And I am not because I’m far too confrontational to ever be a mainstream politician. I would nominate the most liberal candidates I could find for the SCOTUS, especially if the Senate goes to the Republicans. If they reject one, the next one will be more liberal. If they reject that one, more liberal. Let them reject them all and have no one fill the seat.
Conservative legal opponents of Obamacare have asked the Supreme Court to settle a dispute about whether the statute permits subsidies to be provided on the federal HealthCare.gov exchange, which serves residents of 36 states.
There is no good outcome for the GOP in this case. If SCOTUS agrees, red states lose millions, and the political fallout will pit the GOP against itself. If SCOTUS disagrees, and allows the subsidies to continue, those same red states will be subjected to the Obamacare death panels.
A seat has to be empty before you can nominate someone. . . . . something you not telling us?
Knew this was going to be Sahil before I even opened the story…
What we do know is that this court is corrupted and beyond repair.
I offer my amazingly prescient “see-the-future” SCOTUS prediction that this is one case where Justice Thomas is going to sit there and not say a f*cking thing, like usual!
BUT…he will immediately after hearing the first argument, ask for minute-by-minute details about Justice Roberts’ cousin’s first lesbian experience…and if she has a video of it he can enjoy with a can of Coke.
I think it’s just so cute the way TV and print pundits still pretend to believe the SCOTUS Rightie Wingnuttery follow any laws at all. It’s obvious that Scalia et al. just vote however they damned well please. Their personal prejudices are now being enacted into law. Screw the fu*king law books and all that stare decisis crap.
Dear Wingnut Social Cons:
If you really are that concerned about the “sanctity of marriage” sponsor a constitutional amendment making divorce illegal. Until you do, all this blather about ~clutch your pearls!~ gay marriage is just window dressing for your homophobia and you’re not protecting anything other than your right to be a depraved, loathsome and very transparent bigot.
Thanks and best regards,
Sanity
The justices ruled in June that Christian business owners have a right to opt out of a health care requirement if it goes against their religious beliefs. But does a Muslim prisoner who wants to grow a ½ inch beard, as commanded by his faith, have the same right?
LOL. If the court finds for the prisoner, prepare for an absolute landslide of suits from the prison population requesting an incredible array of accommodations (no, not that kind) on religious freedom grounds. The prisoners have the time and the motivation.
The gang of five led the camel over and lifted the edge of the tent for the camel’s nose. Now they will have to make finer and finer distinctions about which animals can stick which body parts under the tent, or the rule of law is going to be buried under the diversity of religious beliefs (and lack of) in the country.
When combined with the Supreme Court’s Minecraftian manipulation of the real world, where spending is speech and corporations are persons that can have religious beliefs, lower courts would find themselves led by Supreme Court rulings to make all kinds of crazy decisions.
FOX Noise weighs in: “Ben—gay—ziiiiiiiiiiiiiiiiiiiiiiiiii!!!”
I just gotta’ post a link to this Onion piece. It’s a classic:
This doesn’t have any bearing on this article, but man does that poster in the first picture piss me off.
Women In control Don’t want Bosses’ Handout.
As if having comprehensive medical coverage is a handout.
And consistent with his history so far, Kennedy will decide that yes, gay people deserve equal treatment on marriage and that laws and attempts to ban it are unconstitutional. He’ll then go on to support all of the surreptitious ways the GOP/Teatrolls/conservative fundamentalists come up with to restrict equal rights for gay people based on their superficial excuses that pretend their legislation has nothing to do with trying to restrict gay rights. You know, just like he supported eviscerating the VRA.
The Kennedy Doctrine: As long as you’re not doing it blatantly and openly and give good excuses in the same vein as Lee Atwater would counsel you to provide, then it doesn’t matter if there’s an obvious disparate impact and questionable motives.
Sometimes I wonder whether the four sociopaths on the Supreme Court realize how corrupt they are. Certainly Clarence Thomas knows that he is financially corrupt as well as ethically corrupt, and Antonin Scalia takes pride in knowing that he is corrupt, but with respect to the Chief Injustice of the United States and the guy who thinks that presidents should have unlimited power as long as they are Republicans, I’m not so sure.
Of course, as expressed in their opinions, all four of them do believe that it is OK for someone appealing a $50 million verdict against it to give a $3 million bribe to the chief judge hearing the appeal as long as it is laundered properly. And they all plus Justice Kennedy feel that anyone should have the right to give multi-million dollar bribes to other elected officials as long as they don’t actually call it a bribe – it’s just that only people who are zillionaires happen to have multi-million dollar bribes to pass out like plastic necklaces at a parade.
“The Supreme Court seldom gives an inch when it comes to the First Amendment”
Unless you’re a corporation, in which case they’ll give you a mile.
I still say they might just throw us a bone on this one. As long as we’re all indentured servants to a private employer, working long hours with no health care, no time off, and no overtime pay, PLUS having to pay the private sector for the use of schools, parks, libraries, roads, and protective services, SCrOTUS has served it’s corporate masters well. They really don’t care who we have sex with.
Scalia does, and I don’t think he is pleased that he is the SC member quoted most often by lower courts in decisions ruling that gay-marriage prohibitions are not Constitutional. He “knows” the Devil is real and is out there laughing at him over that trick.
