“The Supreme Court’s decision to let rulings by lower court judges stand that redefine marriage is both tragic and indefensible,” Cruz said in a statement. “By refusing to rule if the States can define marriage, the Supreme Court is abdicating its duty to uphold the Constitution.”

Me thinks the Cruzster doesn’t understand how the Supreme Court works. In effect, by refusing to hear the cases, the Supreme Court implicitly is saying that the legal reasoning behind the other courts ruling is sound. They did not feel the need to pile on.

He should be happy really. Based on their pass, it shows that gay marriage would survive a court case in front of the Supremes. If they took it, gay marriage would be legal in all 50 states this time next year. As it is, he has a whole extra year to continue to enjoy discriminating against gay people. After that, well…, clearly his heterosexual marriage is over.

Anxiously looking forward to the rabble rousing Cruz will be doing during the Republican primaries. Especially on this issue, because the base is firmly behind him. Sometimes I wonder if Cruz is a Democratic plant.

Cruz argued that no language in the Constitution, nor the 14th Amendment, gives the court the authority to redefine marriage.

Redefining words is something that Cruz and the rest of the Right know quite a bit about. A straight line can be drawn between their linguistic gymnastics in the name of propping up their many sacred cows, and the degradation of political discourse in this country.

That means at least two of the five conservatives voted not to grant cert. My bet is Roberts and Kennedy.

The Supreme Court’s decision was entirely defensible. Until now there is no split in the circuits. The circuit rulings have all been very consistent and well grounded in constitutional law. Anyway Roberts needs more time this term to fashion better tools for his true love the big corporate “people” to use in their never ending quest to trample the “little people”— you and me.
