I do wonder whether, to preserve the reputation of “his” court, Roberts will take on the swing vote role, at least in the less controversial or more procedural cases.

No props to the Trump Court for simply doing what the merits of the matter obviously called for. We can’t start lowering the bar and declaring bipartisan celebrations just because the GOP hacks on the Supreme Court handle a case in accordance with basic principles. There’s no pivot here, folks.

The Justice Department this week asked the Supreme Court to delay the trial while the justices consider its petition to resolve whether “a district court may order discovery outside the administrative record to probe the mental processes of the agency decisionmaker.”

So, is the Justice Department arguing that whatever decision was made was within the purview of the department, so it is not relevant how they came to that decision?

What’s in the “official” record is all that is required…

That’s my question as well: Did Kavanaugh actually vote against the stay, or did he recuse himself?

That information should have been in the story.

You need four justices in order to grant the petition. The three who were in favor of granting that are listed and K. was not among them.

Why would he recuse himself?

Normally the SC does not stop a case that may or may not come before them. The fact that K did not join the bat shit crazies is a plus to me. The three who voted for the stay should probably rescue themself because their minds are made up before the facts are presented before them.

Gorsuch was a disappointment, actually. Doesn’t bode well. Kavanaugh will follow along as well.

So we depend now on Roberts. The ball is in his Court.
