Oooohhhhh, fuck. The assholes waited to see who won the midterms. They wanted to make sure no legislative fix is possible when they regretfully rule that legislative history is of no account and that instead their job is to discern the intent of Congress solely by running the plain language of the statute through their special ODS decoder rings.

And John Roberts is just the guy to write that of decision. Portraying raw, extreme, ideologically driven judicial activism as mere interpretation is what he does.

We’re screwed. The opinion is already in the bag. 5-4. Roberts gets back on board with his BFF’s, Obamacare gets taken down without any possibility of a legislative fix and Democrats get blamed for the resulting mess.

Unless, of course, they have the sense to make Roberts’ judicial activism a campaign issue in 2016 and blame Republicans for the resulting mess.

They can try, but I’m thinking the fix is in. The MSM has already helped the GOP/Teatrolls establish the public’s understanding of the “legislative record” as nothing more than “they shoved it all down our throats.” Nuance proving that it was always contemplated and intended that state-created exchanges would receive federal subsidies is too hard to explain, takes too many words and relies too much on people having an actual understanding how the ACA was and is supposed to function from the get-go, which is yet another thing about which the MSM has gleefully helped the GOP/Teatrolls completely misinform the public. If they rule as expected, then it’s pretty much over. I don’t think this one the Dems can win or message away even if they somehow miraculously get a clue about how to message.

For this to happen the Dems would have to educate the electorate on who the members of the Supreme Court are, what their presumed political leanings are, the adverse effect of their votes on the American way of life, perhaps even how many of them there are, I give no credit to the American electorate to know these things. You’re in rarefied company here and you shouldn’t expect to find the same kind of thinkers outside the left-wing blog bubble.

"In it, they warned that a ruling against the exchanges would 'deprive millions of low- and moderate-income Americans of billions of dollars in federal premium assistance needed to buy health insurance.”

Sigh. What don’t they understand about that being interpreted by people like Alito and Scalia as precisely the reason the ACA should be summarily executed?

Well game over folks, because we know how this is going to go already, with no argument even needed before the court. Funny how they waited until three days after the election to make this decision isn’t it? Well of course it isn’t, because we no longer have a functioning SCOTUS in the way our Founding Fathers envisioned it, and now have a five fascist majority, tasked with doing nothing but carrying out the fascist party’s agenda.

Too bad our horrendous Dem party’s politicians were not bright enough to have seen this coming, and too bad too many Dems didn’t give a damn to get off their asses to vote. I wonder how many of them will be the first to lose their insurance when the SCOTUS hands the fascists another victory? This is what happens when our party allows the right to lie about the ACA, and they run away from it, thinking that was a winning strategy. I swear I do not know why President Obama even cares to finish his last two years as President.

Thank you Dems, because now the SCOTUS can allow the fascists to avoid more repeal votes that would have gone nowhere. Now, the REAL death panels, which have always been the insurance companies, can get back to the business of refusing to cover people with pre-existing conditions, and cause more Americans to go bankrupt, when they thought they had insurance that covered them if they actually got sick.
