Discussion: Supreme Court Voids Deceased Judges' Votes In Decisions Issued After Death

As I recall, Associate Justice Scalia died in February, during the court’s term. Does anyone know if the Supremes handed down any decisions with his name on them after his death?

Wikipedia says not.

The original decision involved equal pay for women, education, and fairness.

No wonder the TrumpSCOTUS quashed it.

I’m pretty sure that’s why they just prop him up in the Hearings and he never asks questions-- their animatronics aren’t that advanced yet.

I don’t know why but this gave me a chuckle. The ghost of Scalia does seem to be everywhere in some people’s minds but I do recall his pending decisions were voided. As much as I hate to see this decision go to a tie vote instead of a majority vote on equal pay, I think this is the correct decision.

I don’t think SCOTUS quashed it. According to the article, all justices agreed with the outcome while only half of (living) justices agreed with the reasoning. So the case will go back to 9th circuit and the reasoning may change but the outcome will be the same.

After Penn State football coach Joe Paterno died the NCAA rescinded a number of his victories, denying him the claim of winningest college football coach. Although no fan of Papa Joe or Penn State, I always thought Penn State should have “rehired” the late Coach Paterno and kept him around as head coach (in spirit) until he regained the top spot.

The Supreme Court’s decision aligns with its own practice — that when a justice has voted in a case but dies before a decision is issued their vote doesn’t count. That happened most recently in the case of Justice Antonin Scalia who had voted in cases that were pending at the time of his death in 2016.

The GOP is dead set against death taxes, so I hope they will howl about death impeachment loudly enough to wake the dead.
