Discussion: Supreme Court May Get Another Chance To Gut Obamacare

Discussion for article #225400

Seriously? IANAL, but isnā€™t the legislative intent pretty clear from the law and the rationale? Careless language should not be the tool by which political battles are won.

Except for further enrichment of people who profit from The GOP Bubble, where is the upside? Spite? How on Earth does that help the GOP politically?

Many Red Staters finally have health insuranceā€“and more to the point: many of their struggling young sons and daughters (and grand kids) over 26 have health insurance. They know whatā€™s what here, despite their bumper stickers and viewing habits.

The GOP higher ups are either stupid or they are just flying by the seat of their pants, hoping a defeat of Oā€™Care helps them, somehow, or maybe that they can blame its demise on PBO.

But there is no way this helps them long term.

Well, this is their M.O. The SCOTUS two step.

What saddens me most about the ruling against Obamacare is that it came too late to help the poor souls that Hilary murdered in Benghazi.

The biggest victim here is the legitimacy of the court system and the solidity of the rule of law.

Thereā€™s always some degree of politics, even in the judiciary, but it appears that ā€œconservativesā€ have decided to throw out norms and precedent and just rule based on ideology under a exceedingly thin veneer of legal justification.

If the Republicans were successful in taking health care away from millions of people, it would make their threats to take away Medicaid more real. Winning this case could be the beginning of the end stage of the end of the Republican party.

If the Supremes ultimately uphold the DC panelā€™s decision (and I
would NOT bet against it), I would feel sorry for the unfortunate people in Red states who would be hurt. But otherwise, this would be a very interesting political development. I almost want to see what would happen in those states when sizable numbers of their citizens get screwed, and are forced to pay more (maybe even pay back what subsidies they thought they were getting).

I recently read that the massive number of ads run by Republicans against Obamacare backfired, and only
had the effect of making people more aware of what was available to them. Republicans, can you spell the word BACKFIRE?

But Goldstein suggested the odds remain daunting for conservatives,
who are seeking to destroy an essential component of a massive new law
on the basis of a dubious technicality. Roberts, for all his misgivings,
proved unwilling to deal a fatal blow to Obamacare in 2012. And now
that millions of Americans are benefiting from the lawā€™s federal
subsidies, stripping them away is a difficult proposition.

Goldstein predicted ā€œthe administration probably will come out ahead in the end.ā€

GOPers canā€™t slap their ass with both hands

It is abundantly clear that Republicans just donā€™t think long term. Whether itā€™s the environment, demographics, education, climate change, or economic policy, they are always focused on short-term gain rather than long-term stability. Their motto is simply ā€œTake the money and run.ā€ They apparently have no concern for what kind of planet their children or grandchildren will have to inhabit.

Iā€™m not sure itā€™ll backfire. National republicans have been getting screwed since Reagan. Southern morons have been getting screwed since Reconstruction.

Wanniski correctly predicted theyā€™d scapegoat Democrats, eg ā€œKeep your hand off my Medicare!ā€ Romney and Ryan were even hypocritical enough to suggest ACA threatened the New Deal while simultaneously marketing ā€œvouchersā€ that would subject tens of millions to medical bankruptcy.

Republicans are inductive thinkers. Raising all boats diminishes their delusions of grandeur.

Must the children be on the grandchildren in order to inherit the planet?

This could be the greatest thing that the SCOTUS accomplishes since making Chimpy the Decider President.

I clicked on this story knowing in advance it was a Sahil Kapur story. So predictable

My guess is the Supreme Court doesnā€™t want it.

The ā€˜en bancā€™ appeal doesnā€™t imply anything about conservative Catholics, does it? Maybe Obama needs to get the Popeā€™s OK for the ACA.

Imagine the potential gold mine the Democrats have if the SCOTUS guts the law. In the South in 2016 you could easily see:

ā€œRemember who took your healthcare away, and brought your kids pre-existing conditions back?ā€

TN could easily flip back to Blue on such a message.

I am feeling more relieved as my children enter the workforce. I didnā€™t want them burdened with paying for other peopleā€™s healthcare. Fuck other people.
