Ethically, Avenatti has to say that he would have to discuss a settlement offer with his client. Settlement is always the client’s call, not the lawyer’s. I don’t think his statement indicates any particular eagerness to settle.

Trump: I had sex with the hooker Stormy on behalf of my lawyer Cohen. Cohen is, therefore, paying her off for the silence.
It’s been a money grab since Day One. The settlement will be confidential. Once completed Trump will loudly trumpet HE NEVER EVEN TOUCHED DANIELS!! And no one will ever be able to prove otherwise, for Daniels will be prohibited from ever addressing the issue in any forum, forever.
After a very quick read of the motion, I think it could actually be a close call on what would normally be the key issues in this kind of case – that is, whether Stormy Daniels entered a valid agreement to arbitrate, and whether the validity of the whole agreement would then be decided by the arbitrator rather than by the court.
But that’s not what this fight is all about from Avenatti’s perspective.
This is about establishing who agreed to arbitrate on Trump’s side. The whole contract is set up as a shell game on his side – the parties are the LLC “and/or” Trump, Trump denies knowing anything about the agreement, and at the same time he’s now joining the case for purposes of compelling arbitration.
Proving that Trump is a party to the agreement and knew about it at the time looks like Avenatti’s immediate goal. Cohen’s lawyer already said on TV that Trump is a “third party beneficiary” to the agreement. The law on third-party beneficiary contracts suggests to me that Trump would not be in that position if he didn’t know about the deal (and if the parties didn’t know they were giving him enforceable rights).
But for Trump to successfully compel arbitration on that ground, he has to admit he knew. And the consequences of that admission will take him to places he really doesn’t want to go.
All of which proves even further that the real object of this agreement was not to enforce it in court, but to keep it out of court at all costs.
Which means Trump has already pretty much lost no matter where the case goes from here.
Also, Avenatti did not introduce the possibility of a settlement. He was asked how he would respond to a settlement offer, and he gave an appropriately noncommittal answer, which makes sense assuming he hadn’t gone over possible settlement scenarios already with his client.

Though he did not rule out a settlement, Avenatti also suggested he would not be happy concluding the case until he gets more information about the hush agreement between Daniels and a business set up by Trump’s longtime personal attorney Michael Cohen.

For some reason, maybe it was just the wording of the sentence in the article, I thought this was about something else.

This is what’s weird about Daniels’ game. If she has the goods on Trump she could certainly milk various publications and television shows, along with a publisher, for quite a sum of money in aggregate. Seemingly more than the check Trump would stroke. And Trump paying her to go away and keep quiet puts to lie to his constant denials. That’s why I think Avenetti is bluffing. Trump is likely unsure what Daniels is holding, and she knows forcing a payoff may be her only route, for she really has nothing much to offer all the aforementioned avenues of money.
