Plus I wonder if he’s sending similar letters to anyone else.
Pretty standard. Putting them on notice that there may be incoming subpoenas and discovery demands is always a good idea. Now, they can’t claim “oops” if they destroy things and they can get in trouble for spoliation if they do. It also sets up a situation where if they do destroy things, the judge can instruct the jury on what inferences are permissible for them to draw from that fact (generally, “they done shredded the evidence cuz it’s bad for them”).
I’m sure that whatever the Trump team does, Cooley heads will prevail.

I don’t know what sort of legal case he’s working on, but he’s got a gift for busting balls.

Will the weak kneed Republicans remember the attack on Bill Clinton when impeachment time comes? Seems like sex is the “got ya” of the political world. Start a real war, conflict of interest, trade wars, lie after lie, enrich self and family, scam contractors, etc etc etc - no repercussions. Have extramarital sex and lie about it and everyone takes notice ( except wife three that did the same thing).
What prevents them from destroying the evidence and claiming it never existed?
Why, conscience, of course.
And the knowledge that anyone even slightly dissatisfied with their current position in the organization will rat them out. Other shady organizations, maybe some loyalty, but the trump white house has proven that there’s none in his orbit. People leak whenever it might lead to the slightest personal advantage.

Cohen claims he made the deal on his own, but he used company email for most or all of the communications about the payment. I assume he will say (or already has said) that it was still totally personal and he just used the company email because it was more convenient or he was worried about the security of his personal account or some other BS. The 2nd lawyer, Jill Martin, says she was freelancing, not working for the Trump Org. If there is no other evidence of communication with someone else at the DT Criminal HQ, what’s next? If someone in a legit org used company email in this way, they’d probably be out on their ass post-haste. The lack of any action by Trump Org against Cohen would indicate that they’re cool with it, but does it count as evidence of any kind?
Federal laws that mandate what records banks must keep and for how long and how secure they must be.
I hope there is a clause in there for the Russian doll of Trump Organization and Trump Foundation shell companies.
