It pretty much eliminates the executive order, based on a cursory review. It certainly eliminates the need, since if someone is genuinely breaking the law, there already is a recourse.

Does Sessions have the authority to determine the scope of the order in this way? I think he’s trying to have at least one EO that’s not permanently slapped down by the courts, but will he succeed on this one by claiming it means nothing? (And then as soon as the injunction is dropped claiming it means whatever he pleases)
It’s basically up to Trump as to whether Sessions has this authority. If this changes things with respect to the courts, that will be up the respective judges. And if Sessions tries to change the rules following such rulings, he’ll be back in court.
