He didn’t confirm Judge Merrick in November of 2016, or did the quite elderly Sen. Grassley forget this? There’s no basis in reality for him to claim that he acted as then Sen. Biden discussed. He, most assuredly, did not.

I think Kennedy wants to retire, but won’t, as long as his health holds and Trump is president.

There is talk about both being options.

Thomas doesn’t really like his job & gets someone who will appoint someone ideologically copacetic. Kennedy was there thirty years & his son knows Trump’s son (or some such connection). His old clerk is on the Court, so he can feel good as well.

Is Grassley tipping his hand that he plans to murder the notorious RBG?

My guess is Thomas. He just wants to drive around I his RV. As far as I’m concerned SCOTUS is dead. Popular vote losers shouldn’t be composing the Court. Democrats will never confirm a republican nominee because of what happened to Garlin. And Republicans will never confirm a Democrat’s nominee.

The rumor is that Kennedy is thinking about retiring. If that happens, kiss abortion rights and the future of the court goodbye. ALL BECAUSE PEOPLE COULDN’T TURN OUT FOR SENATE ELECTIONS IN 2016!!

Kennedy is such a quirky guy. Now that he has a legacy in a couple of landmark decisions on the rights of same-sex couples, he may be less inclined to see it demolished by right wring Neanderthal judges. The Republican plan was that Kennedy would be reassured and made comfortable about leaving once his protĂ©gĂ© Gorsuch as on the court, but I suspect that Kennedy and Gorsuch have moved in different directions since Gorsuch clerked for Kennedy. Gorsuch also came across as an arrogant son of a bitch in his first oral arguments, and I wonder how readily he will fit into the dynamics of the Court. After all, his new colleagues on the Court rejected – unanimously – the Gorsuch-created standard of educational benefit for students with disabilities (in Endrew F. v. Douglas County) even as Gorsuch was being questioned about those decisions.

  2. I’ve been wondering lately if it would have made any difference for Biden to say more publicly last spring. Since these craven senators decided to unilaterally make policy out of one speech, what if Biden had started declaring that he expects every floor speech he ever made about civil rights, health care, women’s rights, etc to become policy 100% supported by all of those republicans? It might have amounted to nothing more than trolling and it still couldn’t have forced republicans to suddenly choose principles over party, but who knows.

I know it wasn’t ultimately supposed to matter since Hillary was expected to win, and I don’t want to point the finger at Biden for republican misbehavior, but Biden was in a unique position here since the claim was being made in his name.

Hard to tell with Kennedy but him engaging with Trump after the speech at Congress & that back channel via the kids is a concern. Kennedy has a range of views, so that too. After all, he was in the dissent that wanted to toss out the Affordable Care Act & joined the majority in Shelby v. Holder (voting rights). He might figure his gay decisions are fairly safe long term. His feelings about Gorsuch as you say is unclear.

ETA: Also, it might turn on who Trump nominates. It is not out of the realm of possibility that Kennedy would have some right to veto and if someone he supports is suggested, he would feel more comfortable retiring.
