Except it does really impart judgment on the merits of the lower court’s decision and it is effectively upheld.

I think that Roberts really does have a certain level of concern for the legitimacy of the judicial branch. Overturning this one would have required completely ignoring the factual record established in the lower courts. And upholding it would lead to who knows what from trump.

True in that it restores, more or less, the balance to the Scalia era. We’ll see once they start ruling on Gorsuch’s favorite pro corporation, pro religion anti personal freedom from those denizens questions. Based on his history I’m not optimistic that he won’t be even worse than the late, unlatmented Antonin.

What’s your point? Getting Gorsuch on the Court was still a huge victory for their side. When the next liberal goes, they will lock in a conservative majority for a generation.

Obsessing over our candidates’ “flaws” rather than supporting our party - it has consequences.

The point is obvious.

Gorsuch* returned SCOTUS to the status quo ante, despite all the blather about how he would change the make-up of the Court.

And why are you so certain that a liberal justice will retire?

He does. It’s why he flipped on the ACA and saved it. He cares about his reputation. Don’t think for a second that implies liberal causes, but he does care about the credibility of the Court.

This appeal was and is not ready for Supreme Court review yet. That’s all the denial of the appeal means. The appeals court ruling temporarily settle some voting rights issues, but this was a particularly blatant example of legislative abuse that was not suitable to be overturned. As with freedom of choice and the teaching of creationism in schools, they will be back with somewhat more refined but still mendacious arguments.
