âGiven the blizzard of filings over who is and who is not authorized to seek review in this Court under North Carolina law, it is important to recall our frequent admonition that â[t]he denial of a writ of certiorari imports no expression of opinion upon the merits of the case,'â Roberts said, citing a 1923 Supreme Court case.
Except it does really impart judgment on the merits of the lower courtâs decision and it is effectively upheld.
Translation: âEven with Gorsuch, we donât have the votes to overturn the decision.â
Basically, the right leaning Supreme Court told racist NC GOP legislators to go pound sand.
no comment yet from Rev. Barber:
This is a huge victory? This means restrictions were voted down and the SC will not review or reinstate restrictions. Asking for a friend.
I can already see Toilet Governor whining about this as he still struggles to find a job considering what a pathetic loser he is
Proof that Gorsuch* didnât alter the balance of power on the Court.
I suspect Trump will be inviting Gorsuch over for dinner.
And then heâll publicly announce that heâs firing Gorsuch. And then the sound of crickets will fill the room.
I think that Roberts really does have a certain level of concern for the legitimacy of the judicial branch. Overturning this one would have required completely ignoring the factual record established in the lower courts. And upholding it would lead to who knows what from trump.
â[t]he denial of a writ of certiorari imports no expression of opinion upon the merits of the case,ââ Roberts said, citing a 1923 Supreme Court case.
What, Roberts is still clinging to the outworn practice of citing precedent? Somewhere, Scalia is spinning.
Iâm picturing a rotisserie.
True in that it restores, more or less, the balance to the Scalia era. Weâll see once they start ruling on Gorsuchâs favorite pro corporation, pro religion anti personal freedom from those denizens questions. Based on his history Iâm not optimistic that he wonât be even worse than the late, unlatmented Antonin.
Whatâs your point? Getting Gorsuch on the Court was still a huge victory for their side. When the next liberal goes, they will lock in a conservative majority for a generation.
Obsessing over our candidatesâ âflawsâ rather than supporting our party - it has consequences.
The point is obvious.
Gorsuch* returned SCOTUS to the status quo ante, despite all the blather about how he would change the make-up of the Court.
And why are you so certain that a liberal justice will retire?
He does. Itâs why he flipped on the ACA and saved it. He cares about his reputation. Donât think for a second that implies liberal causes, but he does care about the credibility of the Court.
And the current GOP would pass court-packing legislation in a minute.
Strict North Carolina Voter ID Law Thwarted After Supreme Court Rejects Case
The move left in place a federal appeals court ruling that struck down key parts of the law as an unconstitutional effort to âtarget African Americans with almost surgical precision.â
Tell your friend not to worry
This appeal was and is not ready for Supreme Court review yet. Thatâs all the denial of the appeal means. The appeals court ruling temporarily settle some voting rights issues, but this was a particularly blatant example of legislative abuse that was not suitable to be overturned. As with freedom of choice and the teaching of creationism in schools, they will be back with somewhat more refined but still mendacious arguments.
I wouldnât want to work in Jeff Sessionsâ office today. (Well, I wouldnât want to work in his office any day.)
Not while Conway is governor.
