Discussion: SCOTUS Upholds Double Jeopardy Rule In Case With Manafort Implications

This is a big ruling (win), isnā€™t it? Isnā€™t it the case that many feared might strike down entirely the ability of states to pursue charges pardoned on the federal level?

Or is there another case still lurking?

Thatā€™s good, no ? Who are the two no-votes ?

The Supreme Court on Monday upheld a longstanding doctrine which holds that state and federal prosecutions for the same crime do not violate the Constitutional prohibition on double jeopardy.

Good, I think.

Ā

Alito wrote. ā€œInstead, the people, by adopting the Constitution, ā€˜split the atom of sovereignty.ā€™ā€

The whole point of federalism in the first place was to deny the ā€œatomicityā€ of sovereignty.

I hope this is a harbinger of things to come. Iā€™ve never bought into the argument that SCOTUS, even with the two he nominated, is going to be in the bag for PP. Iā€™ve thought Gorsuch would be a typical Republican, of course, but Iā€™ve never believed heā€™s going to roll over and hand democracy to Donald John Trump. Heā€™s not a PP Republican. Heā€™s quite the opposite.

O.T. but I canā€™t find a better thread to impose on.
I would be interested in our longtime DC insiders opinions.
But this could explain a lot of why shoot-from-the-hip asshat idiot Chump seems to have a better feel/read on how to play all these investigationsā€¦because he has some real long term, long-game insiders. Possibly why he settled on Kavanaugh against McConnellā€™s and Federalist Society wishes.

From SCOTUSblog:

Judgment: Affirmed, 7-2, in an opinion by Justice Alito on June 17, 2019. Justice Thomas filed a concurring opinion. Justice Ginsburg and Justice Gorsuch filed dissenting opinions.

All kinds of weird combinations of votes coming out today.

I just read it was Ginsburg and Gorsuch dissenting.

Ginsburg and Gorsuch.

I half-expected Thomas to join them but he decided not to.

Iā€™d so love to see him get into a fight with the SCOTUS. I can just imagine him firing off tweets aimed at Gorsuch and Kavanaugh threatening to un-nominate them and then threatening to fire Roberts.

Poor Paulie Walnuts. He just gets no respect, I tell ya, no respect.

Next thing you know weā€™ll be seeing the whole Kockholster Klan dragged into New York State courts, tried, convicted, sentenced and then transferred to the Metropolitan Correctional Center in Manhattan for more fun, this time with the SDNY. Good times.
