That’s a relief. I thought Kennedy (I’m assuming he was vote 5, because I can’t see it being any of the other conservative justices) would say this was a step too far, but I wasn’t 100% sure.

Justice Stephen G. Breyer wrote the majority opinion, joined by Justices Anthony M. Kennedy, Ruth Bader Ginsburg, Sonia Sotomayor and Elena Kagan. Chief Justice John G. Roberts Jr. and Justices Clarence Thomas and Samuel A. Alito Jr. dissented.

I know that I can find this info anywhere, but would it be too much to ask TPM to tell us which justice voted on which side? Is this a site dedicated to journalism or not?

Edit: the original story did not have the names. It was later edited to include the missing information. My comment would have been different had there been an advisory like “vote score to follow.”

This is a small victory. Conservative states are going to continuously pass laws placing impediments in the way of access to abortion procedures. They’ll approach shutting down clinics and restricting the practice from other angles. Each fresh wave of restrictive laws will again place SCOTUS in the position of having to pass judgment. In each new battle the intervening time between passage of that round of anti-choice laws and final SCOTUS decree abortions will be more difficult to access. Rinse and repeat. Conservatives do it on minority voting rights. On LGBT rights. On aid to the poor and disabled. Their hate, racism, bigotry, oppression and misogyny knows no limits. It’s perpetual, never ending. It will be with us always.

The Casey precedent said there could not be undue burden placed on abortion access, including “unnecessary health regulations that have the purpose or effect of presenting a substantial obstacle to a woman seeking an abortion.”

That three justices did not find that the Texas law did exactly this, by forcing closure of all clinics in an area the size of California, is quite disturbing. Thank goodness Kennedy was on the right side of this decision.

Not too much to ask. OTOH, what are the odds Roberts, Scalia or Thomas were in favor?

But since the ruling, haven’t many the clinics closed or moved? Was the intended effect of the legislation to hamstring the clinics long enough to drive them out of business, regardless of the outcome later? I don’t know, I’m just asking.

…an opportunity for the court to clarify at what point a restriction on abortions becomes a significant burden on a woman’s access to the procedure.

Republicans tell us that when it comes to the Second Amendment, any restrictions are a burden. Why should it be any different for women’s reproductive rights?

Yes, Kennedy. I had to dig thru it myself. Can’t find it on any articles yet.

Thomas wanted to keep the law entirely intact. Roberts and Alito would have settled for something slighly less asshole-ish. Scalia in hell is yelling at his brown lawn to an audience of zero.
