Discussion: SCOTUS Halts Ross Depo In Census Case, Will Let DOJ Official Be Deposed

the tl;dr which is all I have time to do: nobody needs to be getting their panties in a bunch about this order.

Except Gorsuch and Thomas’s shamelessly partisan “concurrence” basically saying “hey, we’ve pre-decided this case and think we ought to just shitcan the whole lawsuit!” That was improper and another blow to the Court’s rapidly draining credibility.

It’s the lying Neil, it’s the lying.

The only shocker there is that Alito didn’t also note he would have made the ruling worse

Yep, this is mostly a win…only the Ross deposition was delayed, and it will go forward if the Trump administration fumbles and doesn’t request a full hearing. Odds are the rest of the information will be just as damning in the trial, and they have Ross’ emails and statements about what he did/wanted to point at. It would be better if they allowed the deposition of course, but this almost seems amazing considering what the court is like at the moment…Roberts must have sided with letting all the rest go and trying to say that a Cabinet officer needs extra examination (which doesn’t have any precedence of course).

Almost every move by the SC from now until the conservative block is broken is going to look like this…right wing assholes making statements that are shameful, the left doing actual juris prudence, and Roberts floating in the middle deciding how much he values the institution of law in the US. We can only hope this is a short chapter in our history.

I agree, except I don’t imagine Roberts will be doing all that much floating.

Wait a couple months for your subpoena from Congress, Wilbur.

And so it begins. One more step in slow motion right wing coup. A minority party despised by the majority of America now controls the country. They will not give up power without a fight. Be prepared to go to the mats if you have any interest in restoring representative democracy in the US.

That’s the spirit!

If people can already vote (where you are), help them to do so. Tomorrow!

Well there are three things going on

(1) Thomas and Gorsuch are willing to go full on political and just block the whole thing up. That Ross lied is sui generis to them. Its a positive feature, not a problem.

(2) clearly 5 members were willing to protect Ross. The 4 “dissenters” were not. Keep in mind that this is really improper. The test for a stay is just not met, and the Supreme Court really should not involve itself in these type of decisions. The “harm” is small in Ross having to sit for a deposition, and a showing was made that only he knew the answers.

(3) but 5 were not willing to stay the entire process. The means that Roberts at least (and perhaps Alito) were willing to let the trial go forward. Its also possible that KAV was not willing to be nakedly political at first.

I might also add that if one is looking at this legally, putting off a trial until after the midterms is not so bad for the R’s, they can let the process play out later.

I really wish the Supreme Court would just get back to deciding legal issues, but unfortunately, this Court is just political. Really a pisser.

And what is the result of this? The judge will make findings that Ross lied, and failed to have a “rational basis” for his actions. That makes flipping him at least legally more difficult, and a heavier lift. My guess is it probably does not change the eventual outcome.

“[T]here’s nothing unusual about a new cabinet secretary coming to office
inclined to favor a different policy direction, soliciting support from other agencies to bolster his views, disagreeing with staff, or cutting through red tape,” Gorsuch wrote.

Because lying under oath = cutting through red tape. At least if you’re a republican, that is.

What if the new cabinet member’s views violate citizens rights?

I fear for my children’s future with these stupid conservatives in charge.

I share your frustration.

At the moment, “going to the mats” means getting people — family, friends, neighbors — out to vote.

Starting tomorrow!

It won’t end our frustration; but it’s a necessary step regardless.

(Nothing here you don’t already know. Banal is my middle name.)

We now have a totally corrupted Supreme Court where “Justice” really means "Just Us Rich White Right Wing Xtian Rich Men"

So I sort of get why Trump picked Ross to be Commerce Sec., but did either Trump or Ross know that Commerce Dept. controls the census? And what in Ross’ background shows that he ‘came into the office inclined to favor a policy’ that he probably knew nothing about?

Future history.

What destroyed the United States?
It was rampant tribalism and corruption, son. They got so rich they forgot how they got there - they forgot they were supposed to be a country of laws, and became a country of favoritism to the rich. They started on the principle that all men are created equal and ended by forming an aristocracy and ruling class based on wealth and connections. They simply lost their way.

I see that Thomas has now become the ward of Gorsuch now that he can no longer be the yes-man for his master Scalia.

You are 100% right. Unfortunately I am, like a lot of Democrats, somewhat limited to just cutting checks, since my congress person is Nancy Pelosi, and my city voted 84.84% for Clinton.

The closest race to me is 100 miles away and they don’t want volunteers.

And yes, that means Gorsuch and Kava-nah.
