Ah, the ridiculous Hillary’s E-mail nonsense, the dreadful mistake that just keeps giving benefits to conservatives. It just seems that people fighting on the side of decency have no chance for success. The tools are just stacked too heavily against them/us.
Not in this case. In this case it’s making the case for Democrats for full release. Since DOJ was eager to pass along basically everything they had from their investigation there, it makes it harder for them to argue now that they can’t mention anything bad about an uncharged individual.
Nothing makes any argument “harder for them.” They are bound only by whatever argument seems to fit their particular position at a particular point in time. We are fooling ourselves if we pretend that they are in any way constrained by norms, traditional guidelines or precedence.
DOJ is. And if Schiff does have to sue, the precedent makes their defense much harder in the courts.
That is what we will see, presumably in the coming weeks or months. Under the rule of the Orange Menace, I am not sure that any of our integrity or institutions can prevail. I really hope that i am wrong about that.

What a difference an election makes. Under the previous chair, Devin Nunes (R-Moscow), this never would have happened. Bravo, Congressman Schiff, for actually upholding the Constitution and not knuckling under to the Trump criminal gang. This report is going to come out, one way or another; many here are too young to remember the Pentagon Papers. Those weren’t supposed to be made public, either.
The projection as always is spot on.
“We will take it to court if necessary. And in the end, I think the Department [of Justice] understands, they’re going to have to make this public.”
I don’t like the fact that a prolonged battle is anticipated and factored in. On any view, there is a danger that Barr will delay matters for as long as possible, taking it to the Supreme Court if necessary, and throwing a variety of spanners in the works. There should be formal undertakings requested now that Barr will forthwith disclose the report in full to Congress, there being a presumption that the report will adhere in good faith to the DOJ’s brief and that the SC will have appropriately exercised his discretion as to what to put into the report or not put in it.
There should also be a resolution to this effect passed in the House and a further resolution that the investigation results are of utmost gravity and urgency as a matter of national security.
I’m far from suggesting that these are magic bullets, but maximum formal and official pressure should be applied to Barr and to any judge. Talking about things on TV is necessary but not enough.
Until you’re an injured party, you don’t have standing to sue. You have to have Barr release the report (while withholding whatever) before you can start taking it through the courts. Many cases end up getting tossed on the “standing” technicality.
Oh yes, it’s been gratifying to see the Democrats in the House roar to life now that they have the majority.
I almost forgot what it was like to have a Congress that took its job seriously and didn’t cower under their desks in fear of an authoritarian president, or let their actions be driven by the reams of kompromat from a foreign government.

Agreed–it would be premature to sue if no undertaking is forthcoming at this point, since Barr himself has not seen the report and won’t bind himself in advance to a particular course of action. I’m talking about exerting the maximum pressure and using the House of Representatives as officially as possible. We do control a branch of government. We should throw our weight around. Republicans would not hesitate.
