The “I don’t want to answer those questions” privilege now comes in another form. First, there was the Sessions’ “the president might want to claim executive privilege at a later date” excuse. Now, Junior comes up with a novel and incorrect interpretation of the well-established attorney-client privilege. And the Republicans on the committees go along with any excuse not to answer and will not demand answers (because the Republicans don’t want that info out there either). Might as well say, “My reason for not answering is wicky-wicky-wongtooth-throat-warbler-mangro,” and that’ll be just fine with the Republicans.

Don’t confidentiality rules specifically work the opposite way? If I am with my lawyer, and an unrelated party joins us, then privilege ends.
Otherwise, criminal conspiracies can be hidden by this mechanism.

Was Trump Jr.'s lawyer present, or just somebody who happened to be a lawyer? I guess Junior could copy Alan Dershowitz on all his emails from now on and claim they are “privileged.” What a twit.

Having a third person present destroys the privilege. You need to be in a private setting and only the attorney and his staff present for there to be privilege. Don Jr., a rich twit, will be held in contempt somewhere along the line for asserting a non-existing privilege

There is a “common defense” privilege, which permits those accused in a proceeding (a conspiracy to rob a bank, for instance) to confer with their lawyers and other defendants to plan strategy.

Just to note: If there were lawyers listening in, and Don Jr. did not exercise the privilege, then he might lose it for any conversation with his lawyer. So any attorney worth her salt would tell him to exercise the privilege until a court tells him that it doesn’t apply.

Jesus Christ Almighty that’s lame. I’m not sure we’ve entirely explored the significance of the lame, uncool quality of this family and the whole coup d’etat they sit atop. It’s one of the more obvious things, though, when you think about it. It’s the backlash not just of white privilege but of the stupid lames who feel put-upon and disrespected. I wish I could describe them in a more respectful way but their being unworthy of respect is basically what the problem is.

If that’s what Junior’s talking about then fair enough. :smile:

As far as I know, attorney-client privilege only applies to lawyers protecting conversations with their clients, not the other way around.
