Can’t write a dissenting opinion without coming up with at least something.
If you allow hysterical ideology to infect your mind, then this is the result.
Scalia needs to resign.
We all make mistakes, but this is a mistake made by a man who forgot his own ruling–which wasn’t that long ago–and he’s got a slew of highly skilled clerks to help him.
Scalia has always said that once he could no longer properly perform his duties as justice, he’d step down. I’m not going to say he’s senile, because that’s a strong word, and while some of the things that come out of his mouth lately strike me as demented, that doesn’t mean he’s got actual dementia.
However, I note in passing that both his parents died when they were just a little older than him. The odds of him being one of those guys who makes it to 90 with all his marbles are basically zero.
One of his parents–forget which–died of a stroke. But not all strokes are fatal, or even that noticeable. A fairly serious stroke can occur during sleep, and go undetected. Major changes to one’s mental processes can be caused by such a stroke, and you don’t even know it.
Scalia just doesn’t seem right lately–I’ve always disagreed with him, but he seemed coherent in his opinions. Lately, not so much.

Hundreds of lawyers all over the United States will rejoice today; anyone who has ever been on the receiving end of Scalia’s condescending sarcasm. And I guess that one or two law clerks in Scalia’s chambers will have a very unpleasant day…

I can’t help but wonder if Scalia is suffering from early stages of dementia. Either that or he’s just phoning it in. What the hell; it’s not like he suffers any consequences. He’s got a lifelong gig until he decides to leave and I sure don’t see that happening any time soon.
Time for Scalia to retire and be a pundit on FAUX News.

Well, the rock upon which the Church of Teabaggery stands just developed a huge crack.
I’m not ready to say Scalia must go based on one incident.
But his next few opinions definitely deserve close scrutiny to be certain that this incident is isolated and not part of far larger medical problem.
I would love to see him gone, but only for the right reason.
Now he’s dissenting from his own opinions? How’d ya like to clerk for this idiot? You’d be drowning in confusion and contradiction on a daily basis just trying to get him to focus.

Even when some older person puts themselves and everyone else at risk, there are ways to permanently take away their car keys. Not so with a Supreme Court Justice I see. If only we could take away the Court from him so he didn’t keep trying to drive it into the ditch.
I can honestly see Scalia believing American Trucking went the other way because it fits his current world view. Also, Scalia has made it eminently clear that what he says/believes now is so much more important than what he said/believed in the past – and if that means he gets his own decision wrong (and yeah, I have to believe at least one clerk brought him his own opinion, and that clerk was on the shit list for the rest of the week), then so be it.

I believe we are seeing, or rather have been seeing, the early signs of dementia in Justice Scalia. It is time for Justice Scalia to retire.

Yes, my dad had a number of small strokes that took him from his pre-stroke persona of highly capable teacher to someone who really was unable to do a lot intellectually. Making errors is the tell, too.
He might make a mistake but his clerks do the research. Many clerks do the actual writing. I don’t know if he is one of the few judges to do the actual writing. That he and his clerks missed this is really bad. Either he over rode their research or his office is not well managed.
This article is confused. In Justice Scalia’s case, he can not only have his own opinion, he can have his own facts. He’s sure that was the original intent of the authors of the Constitution.
